The commercial center was built in 1987. Last month, the property owners approached the city with plans for a 9,735 s.f. day nursery to be located in the center. The city requires a property to be platted before issuance of a building permit. TRANSPORTATION: Wrangler Road is a 2-lane asphalt road with side ditches in a 60' wide right-of-way. The thoroughfare plan shows it as C4U in a 70'-wide right-of-way. Crestside Drive is 4-lane undivided street in a 60'wide right-of-way. Item # 10 SURROUNDING LAND USE & ZONING: North- South - East - West - Vacant; "LI" Light Industrial Vacant; "LI" Light Industrial Vacant; "LI" Light Industrial CMS West Campus; "C" Commercial COMPREHENSIVE PLAN: The Comprehensive Plan shows the property suitable for light industrial and showroom uses. DISCUSSION: The request for a day nursery to be located in the existing Nikor Commerce Center prompted the need to plat the property. A day nursery is a permitted use in the Light Industrial zoning district, therefore, a site plan review of the nursery is not necessary. However, we are reviewing the overall site plan of this commercial center. As this is a comer property, the front yard setback must be observed along both Wrangler and Crestside Drives. Applicant is observing the setback requirements on both the Plat and Site Plan. However, on the Site Plan shown on the Survey Map, the applicant is proposing to fence approximately 3,150 square feet of lawn area adjacent to the 16,960 square foot building to be used for an outdoor play area for the proposed day nursery. This fence is proposed to come within approximately 2 feet of the street right-of-way. The fence code specifically states it is unlawful to erect or maintain a fence within the front yard of any lot, from the front building line to the front lot line. The applicant will have to go to the Board of Adjustment to seek relief for the placement of the fence. As stated in the letter from the applicant, they fully intend to go to the Board for the fence variance. The survey map shows a 5' building line adjacent to the southern and western property lines which has been recorded with the deed records of Dallas County. The zoning ordinance requires a 10' side and rear setback in a Light Industrial zoning district. The minor plat shows the correct setback lines and the more restrictive regulations will govern. Although staff has concern of the day nursery being located in an industrially zoned area, it is a permitted use. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Staff recommends the following: Approval of the Site Plan with the condition that the Board of Adjustment grants a variance to allow the location of a fence in the required 30 foot front yard setback. Item # 10 Approval of the Minor Plat subject to roadway impacts fees being paid to the City prior to flae plat being recorded with the County. (See Engineering comment.) ALTERNATIVES: 1) Recommend approval of the minor plat and site plan 2) Recommend disapproval of the minor plat and site plan 3) Recommend approval of the minor plat and take the site plan under advisement. 4) Recommend disapproval of the minor plat and take the site plan ander advisement.
