ParkW CC-1/FP-CS 900507GINN, INC. · ' G ENGINEERS ......CONSUL 1 IN PLAT/PI3/~N~EVI EW MEMORANDUM Date: May 7, 1990 To: From: Re: City of Coppell Public Works Department John C Karlsruher, P.E ~ Park West Commerce Center Landscape, Irrigation and Grading Plans We have reviewed these plans with the Public Works Department Section Heads and the have following general and specific comments: General: Based upon staff's review and our visits to the site we conclude that the landscape, grading and irrigation work along Belt Line Road does not meet the City's requirements and does not comply with the conditional terms of approval of the Final Plat by the City Council on April 10, 1990. The berms, landscape and irrigation still encroach the public R.O.W. and will interfere with the sidewalk installation required by conditions 8 and 7 of the attached April 11, 1990 letter from the City of Coppell to Mr. Don Davis. The current grading of the 14' wide parkway along Belt Line Road will make it nearly impossible to construct a 5'- 0" sidewalk as required with a maximum allowable cross slope of 5% or 20:1. Staff has also noted that the current landscape, grading and irrigation all along Airline Drive will present similar problems with future sidewalks. It appears that if sidewalks are required · in accordance with the Subdivision Ordinance, much of the landscape and irrigation will have to be modified at the property owner's expense. The plantings screening the electric power transformers seem to be the worst offenders. SDecific: Sheet L-1 shows proper 14' parkway width dimension along Belt Line Road, but both the roadway and the parkway are drawn to the wrong scale. This may cause much confusion in the future. 2. Sheet L-2 has the same problem as Sheet L-1. Sheets L-4, L-5, and L-6 show landscape encroaching the public R.O.W. and it appears that future sidewalks would interfere with the landscape. 17103 Preston Road · Suite 100 * LB 118 · l)allas, Texas 75248 · Phone 214/248-4900 10. 11. Sheet I-1 shows irrigation facilities located in the public R.O.W. which may interfere with the future sidewalk. On Sheet I-2 it is not apparent whether the water meter shown is existing or proposed. Please clarify. On Sheet I-4 the details for the Double Check Valve Assembly and the irrigation connection to the water main both need to be revised. On Sheets G-1 and G-2 the grading within the 14' parkway on Belt Line Road does not comply with the Subdivision Ordinance; exceeds the 5% (20:1) maximum allowable cross slope for a sidewalk; and the grading has covered up valve stacks and other appurtenances related to the operation of the City's water system. These must be properly located and identified by the Developer prior to a final inspection. On Sheet G-3 the note pertaining to "Water Meter" needs clarification. It is ambiguous in its current form. On Sheet G-4 the landscape and irrigation facilities interfere with the future sidewalks. On Sheet G-6 the Belt Line Road cross-section is not in accordance with the Subdivision Ordinance and does not agree with the provisions of the 4/10/90 City Council stipulations for approval of the final plat. The slope of the parkway is the main issue. It appears that the grading in the area of the traffic signal controller at Cowboy Drive/Belt Line Road has been modified to suit our previous comments. We need confirmation that the irrigation system has been suitably modified to prevent water from being directed onto and into the controller cabinet. The conditions for approval are as follows: 1) Final construction plans and profiles (sewer, water, storm drain) must be submitted by July 10, 1990. 2) Covenants/restrictions re§ardin§ open space area must be executed by May 10, 1990. 3) Flood Plain Management Ordinance will be followed, and Hydraulic Studies must be submitted by July 10, 1990. 4} Participation in fair share of the sanitary sewer improvement costs. 5) Twenty (20) foot utility easement required, unless ten (10) foot easements are approved by staff. 6) Applicable development fees will be paid as each lot is developed. 7) Sidewalks will be constructed when: 1) majority of property owners association wants them, or 2) the Director of Public Works deems needed 8) Sidewalks along Beltline will be constructed in addition to the above condition number 7. 9) Infrastructure will be constructed as needed. 10) Southwestern Drive will be constructed as four-lane divided when: A) traffic exceeds 8000 trips per day, or B) as determined by the City Engineer ll) Construction permit fees will be collected on a replat-by-replat basis. Conditions requested under this plan are that the final construction plans and traffic study have not yet been delivered. These two documents are to be delivered as soon as possible. Following discussion by the Council, Councilman Smothermon moved that the final plat be approved with the two documents being transmitted as soon as possible. Councilman Robertson seconded the motion; motion carried 6-0 with Mayor Pro Tem Wilkerson and Councilmen Morton, Smothermon, Cowman, Robertson and Nelson voting in favor of the motion. Item 11: Consider a preliminary plat for Gateway Business Park Addition, along with variances, located at the northwest corner of Freeport Parkway and I.H. 635, at the request of Santa Fe Realty. Director of Planning and Community Services Gary Sieb made the presentation to the Council. Mr. Sieb informed the Council that this tract is a 104 acre development. The roadway through this development is affected by the previous decision of the Council under Item #8 and, therefore, would show a thoroughfare with a four-lane undivided 70 foot right-of-way on the final plat rather than the four-lane divided thoroughfare as shown on the preliminary plat. In addition, four variances as follows have been requested; 1) the landscaping of parkways shall be completed as individual lots are developed; 2) all applicable fees shall be paid by the lot owners as the individual lots are developed; 3) although Freeport Parkway is a secondary image zone, no trees will be permitted along the west right-of-way because of the existing overhead electrical transmission line; and 4) temporary drainage to be carried by grass-lined channels without a concrete invert or brick facing on headwalls. The channel is to be an enclosed pipe system as individual lots are developed. Concern was expressed by the Council on variance #4 regarding the drainage channel. Acting City Engineer Shohre Daneshmand stated that Variance #4 will be addressed prior to the final plat coming before the Council. If it is determined that the velocity of the water is too high, some means would be used to reduce this velocity. Following further discussion on this item, Councilman Robertson moved that the final plat be approved with the four variances as requested as well as the thoroughfare being a four-lane undivided 70 foot right-of-way with heavily landscaped medians at the entrance of Gateway and Freeport Parkway. The median is to be at least 125 feet in length. Councilman Cowman seconded the motion; motion carried 6-0 with Mayor Pro Tem Wilkerson and Councilmen'Morton, Smothernon, Cowman, Robertson and Nelson voting in favor of the motion. Item 12: Consider a final plat for the Meadows Addition, Section 6, Phase II, located at the southeast corner of Parkway Boulevard and Samuel Boulevard, at the request of Meadow Glen Properties. Director of Planning and Community Services Gary Sieb made the presentation to the Council. There are no variances requested on this plat. Following discussion, Councilman Robertson moved that the final plat be approved as submitted. Councilman Morton seconded the motion; motion carried 6-0 with Mayor Pro Tem Wilkerson and Councilmen Morton, Smothermon, Cowman, Robertson and Nelson voting in favor of the motion. Item 13: Consider a final plat for Park West Commerce Center, and a request to vacate the previously filed plat for Gateway Park at Coppell, located at the southwest corner of Beltline Road and Southwestern Boulevard, at the request of Prentiss Properties. Director of Planning and Community Services Gary Sieb made the presentation to the Council. Eleven conditions are bein~requeste~ by the applicant. Mr. Sieb read those conditions which are file~ as a permanent part of the records of this plat file in the Planning Department. ...... ~, w~,~u~L ~ lx~eQ as a part ot the permanent records in the Planning Department for this development, and which are agreed upon by the developer and City Staff; that the roadway be reduced from a 110 foot right-of-way (six-lane divided thoroughfare), to a four-lane divided thoroughfare (90 foot right-of-way). Councilman Smothermon seconded the motion; motion carried 5-1 with Councilmen Morton, Smothermon, Cowman, Robertson and Nelson voting in favor of the motion, and Mayor Pro Tem Wilkerson voting against the motion. At the request of Council, the following statement is included as a part of the record for this item. The Applicant, represented by Michael R. Tucker, stated for the record that his interpretation of the phrase " as determined by the City Engineer" contained in No. 7d of the aforementioned document is "that if there is traffic, truck traffic being generated and the road needs to be improved, that's fine with me. I am just trying to build it when there is a need to have it built." Item 14: Consideration of a request from Mr. Andy Johnson to waive the fee required to request a building code variance from the Code Advisory and Appeals Board. Chief Building Official Dale Jackson made the presentation to the Council. Mr. Jackson informed the Council that the Code Advisory and Appeals Board does not have the authority to waive the fees. However, they are the proper authority to hear and consider a variance from the Building codes. Following discussion on this item and review of plans as presented by the Inspection Department, Councilman Smothermon moved that the $50 fee for appearance before the Code Advisory and Appeals Board be waived and the applicant appear before this Board for the termination of the variance. Councilman Robertson seconded the motion; motion carried 5-1 with Mayor Pro Tem Wilkerson and Councilmen Smothermon, Cowman, Robertson and Nelson voting in favor of the motion, and Councilman Morton voting against the motion. Item 15: Consideration of a request from Debbie Teer to allow work to begin at the Valley Ranch Centre prior to the completion of landscape work or escrowing of funds as required by Section 33.3.1. of the City's Zoning Ordinance. Ms. Teer is requesting the City waive the escrow requirement for a period of 60 days. Chief Building Official Dale Jackson made the presentation to the Council. Mr. Jackson informed the Council that this development is located at the intersection of Beltline Road and MacArthur. The request from the applicant is for a building permit to complete electrical and telephone work so that the computers can be installed and is for this development only. It does not include the Tom Thumb Store. City codes require that landscaping be provided in escrow prior to the issuance of a certificate of occupancy. Ms. Debbie Teer was also present to discuss this item with the Council. Following discussion on the item, Councilman Robertson moved that the request for a building permit to be issued be approved, but that a certificate of occupancy not be issued until the escrow funding is available. Councilman Cowman seconded the motion; motion carried 6-0 with Mayor Pro Tem Wilkerson and Councilmen Morton, Smothermon, Cowman, Robertson and Nelson voting in favor of the motion. Item 16: Request from Mr. Walter Pettijohn to appear before City Council regarding Ordinance ~90370 - Review of areas of the City. Qonstructlon Pl an~: Construction plans for the inframtructure of-the entire 328 acre development will be provided within ninety (90) days of approval of ~he final plat by City Council. Providing drawings for the entire development assure~ th~ City that the infrastructure will be constructed in accordance with a master pla~. Any significant deviations from the master plan will require complete review of thc entire 328 acre development. ~Dnst~uct~on of Infrastru~tur,~: Utilities a~d roadways will be constructed when nee'~d to support development of any new lot. Con~truction permits must be obtained from the Public Works Department for such infrastructure improvements ~d a l~tter of final acceptance of infrastructure is rec/uired before a building permit can b~ issued. However, if in the opinion of-the Director of Public Works it is warranted, the Director may recommend to the Building Inspec~ion Department that a temporary building permit be issued with the understanding that the final letter of acceptance will be procurred within a reasonable time. Prio~ to construction, the builder must obtain a building permit. Before a structure is occupied, a certificate of occupancy must be obtained. Any requirements for infrastructure or building development in effect at the time of construction must be followed unless otherwise addressed in these conditions. During the replattlng phase, the infrastructure needs wlll be assessed. Obtaining a building permit will trigger ~he construction of any additional infrastructure necessary. Finally, the additional infrastructure needed for the construction of buildings on any replatted lot will need to be fully installed prior to the issuance of a certificate of occupancy for that lot. ~_pn~truction Permi. t Fe,~: The City currently requires that 100% of the of the filing fee for the final plat be escrowed prior to approval of the final plat (the "inspection fee"). Additionally, the Subdivision Ordinance =squires the Developer to escrow an amount equal 'to 1.5~ of the cost of items to be constructed for dedication to the City (the "Construction Permit Fee"). A variance to Section XVI, Paragraph E of the Subdivision Ordinance is hereby granted to allow the Developer to (i) pay inspection fees prior ~o the approval of final replete in amounts equal to 100% of the filing fee for each respective replat; and (ii) pay the construction permit fees prior to obtaining construction permits for improvements necessary for each replat in amounts equal to 1.5% of the items to be constructed for dedication to the City necessary for each resDective replat. d. ~outhwester~ Driy~: Southwestern Drive shall b~ constructed as a four lane divided thoroughfare. Construction of Southwestern Drive shall be deferred until such time that traffic on Southwestern Drive exceeds 8000 trips per day or as determined by the City Englnepr. ~: Sidewalks shall be provided along Belt Line R~ in accordance with the City Subdivision Ordinance. Sidewalks for the remainder of the development will be installed b the property owners' association when deemed necessary by a y the majority of property owner~, or the City.
