I have reviewed the letter from Mr. Thomas Siems, regarding abandonment of an access
easement on lots 20 and 21 of the Pecan Valley Additon. Initially, my thoughts to a possible
solution was to file a separate instrument, in order to get rid of the easement. I talked with
Larry Jackson, City Attorney and he advised that an amended plat should be submitted to the
Planning and Zoning Commission and to the City Council for final review. There are
several considerations that need to be addressed prior to Larry's decision, such as:
1) Have either of the lots been sold to home buyers?
2) Have structures been built on either of the lots?
3) If construction has started, have either one of the owners closed on the property?
In the meantime, I have faxed a portion of the plat to Larry for review and I also talked with
Bill Anderson. Bill is willing to do what it takes to abandon the access easement, and is
awaiting instructions from the city as far as procedures are concerned. The most simple and
virtually hassel-free way to handle this request is to prepare an abandonment of easement
request, and submit to the Planning Commission and then forward to the City Council for
approval of the resolution. It is possible to place this request on the December P & Z and
the January City Council for adoption.
As soon as receive an answer from Larry, I will forward his response to you.
