Re= Riverchase Golf Club
Dear Sirs:
Recently, we were made aware of the development details
for residential property surrounding Riverchase Golf Club. As
Corporate Legal Counsel for the owner of Riverchase Golf Club, I
am concerned that some residences may receive more golf ball
intrusion than is customary for residences adjoining golf
courses.
As you are probably aware, there is a covenant in place
on all property adjoining the course that holds Riverchase Golf
Club harmless for personal injury or property damage resulting
from errant golf balls. This covenant not withstanding,
Riverchase Golf club feels additional protection may be
appropriate for our future neighbors at some critical locations.
Normally, occupied property would be set back far enough so as to
avoid most errant shots. It appears that such setbacks may not
have been provided for in the plot plan which the City Councll
has been asked to approve at Tuesday's hearing. In the absence
of sufficient setbacks, we may be required to construct
protective screens of Doles and netting. We trust the City will
cooperate with us in approving any necessary screens to reduce
future liability for the golf course, developer, home builder and
city planners. If the city has a restriction or problem with
such screening, it may be necessary to reconsider planned
development in some areas, and the City may want to visit this
issue prior to Tuesday's hearing.
