Staff memo re case and add. zcADDITIONAL LAND AREAS WHICH MAY BE CONSIDERED FOR REZONING ZC-553 (CH) On April 12, 1994, in considering zoning change ZC-553 (CH), in which Planning Commission had recommended SF-7 on the TH-1 parcel, SFo7 on the MF-1 parcel, and O on the MF-2 parcel with the buffer strip (see attached map), the Council held the case over to the June 14 public hearing and directed the Commission to consider elements of the attached letter from Art Hewett, dated April 8,1994 and addressed to City Manager Witt (who distributed the letter to Council). In discussion with the Chair of the Commission, it was suggested that Mr. Hewett's letter be distributed to Commission before any definitive action was taken involving any rezoning hearings so that a comprehensive analysis of the proposal could be discussed among the Commission. After discussion and the practicality of such a request has been thoroughly investigated, the Commission may wish to take some formal action. One item that was raised early in staff comments was the density of the proposed TH development as opposed to the density of the current MF-2 zoning. The attached note was conveyed to staff by Jerry Ragsdale, Mr. Hewett's assistant. Staff will be prepared to discuss this item in detail at the hearing. Other Areas for Possible Rezoning There are other areas which may be subject to further study for rezoning including the area just south of the bridge on MacArthur Blvd., an area along Sandy Lake Road, and other sites that may be discussed by Commission members. Staff will be prepared to comment on these and other areas at the public hearing. Item 17 REPUBLIC PROPERTY GROUP. INC. Arthur E. Hewett Pre~ident'CEC) April 8, 1994 Mr. Jim Witt City Manager Post Office Box 478 Coppell, Texas 75019 Dear Jim.- The purpose of this letter is to confirm the position of Republic, as owner and developer of Riverchase, concerning two specific points of negotiation during this downzoning process. As you well know, on January 28, 1992 - only two years ago - the Coppell City Council unanimously reconfirmed the existing zoning at Riverchase. That reconfirmation was an integral part of Republic's purchase decision. For this reason, we believe that Riverchase zoning deserves separate treatment from other tracts in Coppell. Nonetheless, in a spirit of compromise, we are committed to seeking a middle ground which accommodates moderate and reasonable viewpoints. If the City Council will honor its recent commitment to Riverchase zoning, I hereby commit Republic to the following obligations~ 1. 40 Acre MF-2 Tract. This tract is situated south of Riverchase Drive, and north of the railroad track. It was originally zoned HF-2 in 1985. The zoning was also designated MF-2 by the Comprehensive Plan in 1987. It is zoned MF-2 currently and is not targeted by the Planning Commission for downzoning. Please see Exhibit A for its location. Our commitment on this tract is to develop one and two story, single family, for sale (not rental) townhomes which is permitted by the MF-2 zoning. We will begin with a first phase of approximately 45 homes and continue with other phases, so long as a reasonable market exists. We will begin this process immediately (within two weeks) by submitting a preliminary plat for the City's approval process. We will work with the City Staff in a cooperative spirit to present to the Planning Commission and City Council a single family neighborhood acceptable to all. 2. Future CED Sales. There has been speculation that if the City Council confirms the MF zoning at Riverchase but does not approve the CED plat, then Republic might sell CED another MF tract with confirmed MF zoning. We will not - period. 8440 Walnut Hill Lane, 8th Floor · Lock Box 3 · Dallas, Texas 75231 · (214) 373-6666 · Fax (214) 691-4023 Mr. Jim Witt City of Coppell April 8, 1994 Page Two I trust that this will confirm Republic's commitment to the City on these points, as well as our willingness to cooperate in seeking a fair resolution.
