Dear Isabelle:
Pursuant to your re, quest, the undersigned reviewed the Declaration of Covenants,
Conditions and Restrictions for Riverview Estates, Coppell, Dallas County, Texas and provide the
following comments.
Initially, we note that the Declaxation and in particular Article IX, {}9.1 insufficiently
defines common a~cas. While the definition of common areas includes a general description ofthe
types of properties or facilities considered common areas, it does not describe any specific
property as common area nor does it make reference to common areas as shown on the recorded
plat. Moreover, the Declaration does not provide for the maintenance of the median on
Riverview Drive.
Next, we note that the Declaration does not permit the City to maintain the common arm
and to assess the costs if the Association or its Board should fail or refuse to maintain the
common areas.
Finally, please note that we did not review the Declaration to determine if the same is
consistent with the zoning for subject property. We assume that the Planning Department has
reviewed the Declaration to ensure the same is consistent with the applicable zoning.
