KNOW ALL PERSONS BY THESE PRESENTS:
THIS FIRST AMENDMENT TO DECLARATION OF COVENANTS, CONDITIONS AND
RESTRICTIONS (the "First Amen~lment") is made by Austin Catbird, L.P., a Texas limited
partnership (the "Declarant").
WITNESSETH:
WHEREAS, that certain Declaration of Covenants, Conditions and Restrictions (the
"Declaration") was established on August 20, 1997, and recorded in Volume 97183, Page 3085, of
the Real Property Records of Dallas County, Texas, to subject that certain real property located in
Dallas County, Texas, being more particularly described therein (herein called the "Subdivision") to
the covenants, conditions and restrictions contained therein;
WHEREAS, as of this date Declarant owns the entire Subdivision;
WHEREAS, Declarant desires to amend the Declaration'and pursuant to Section 7.1 of the
Declaration, Declarant has the full right, power and authority to amend the Declaration; and
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which are hereby acknowledged, the Declarant hereby amends the Declaration as follows:
Section 2.7 of Article II of the Declaration is hereby deleted in its entirety and the
following is inserted in its place:
Building Materials. The total exterior wall area (as used herein the term "total
exterior wall area" shall exclude windows, doors and gables) of the front of each
building (all stories) and of the first story of the sides of each building constructed
or placed on a Lot shall be not less than one hundred percent (100%) brick (as used
herein the term "brick" shall include brick, brick veneer, stone, stone veneer and
masonry but specifically excluding stucco and concrete blocks) and the total exterior
wall area of each building constructed or placed on a Lot shall be not less than
eighty percent (80%) brick in its entirety. Roofing shall be of a substance acceptable
to the City and shall have a minimum six foot (6') to twelve foot (12') roof pitch on
the major portions of the building.
Any term or provision not otherwise defined in this First Amendment shall have the same
meaning as assigned to it in the Declaration.
Except as amended hereby, the Declaration shall remain in full force and effect and is hereby
ratified and confirmed in all respects.
