Decision of Planning and Zoning Commission: Approved (5-0) with the provision
that the thirty foot side setback along Bethel School Road be adjusted to meet
the code, and that the width of the lots also be adjusted.
Ail applicable fees have been paid at this time. Please refer to the attached
Staff Report for further evaluation.
During consideration of this item at the Planning and Zoning meeting on May
18, i989, an issue regarding the side yard setback for Lot 33-R3 was considered.
The plat and zoning exhibit, which was submitted to the Planning and Zoning
Commission, showed a 30 foot side yard setback along Bethel School Road. Since
the Comprehensive Zoning Ordinance only requires a 15 foot minimum setback in
(SF-9) districts, the applicant agreed to adjust the building line on Lot 33-R3
from 30 feet to 15 feet, thereby providing an additional 15 feet to be shared
amongst 33-R1 and 33-R2. These two lots have been amended on the replat for
Shadowridge Estates, First Increment. Section 12.2(b) of the Comprehensive
Zoning Ordinance requires that all lot widths in the (SF-9) district, be a mini-
mum of 75 feet. Because of the reallocation of lot widths, the variance request
made by the applicant, was no longer necessary. A motion was then made to
approve the request with the provision that the 30 foot side setback along
Bethel School Road be adjusted to meet the code,

Item 9: To consider approval of a replat for the Shadowridge Estates
Addition, First Increment, Lot 33, located at the northeast
corner of Bethel School Road and Plantation, at the request of
Centex Real Estate Corporation.
Taryon Bowman introduced the item to the Commission.
Steve Stolte of Centex Real Estate was present to represent this
item before the Commission.
Chairman Munsch opened the public hearing and asked for persons
wishing to speak in opposition to this change. There were
none. He then asked for persons wishing to speak in favor of
this change. Again there were none.
Following discussion Commissioner Johnson moved to approve the
replat for Shadowridge Eastates, First Increment, Lot 33, with
the provision that the thirty foot side setback along Bethel
School Road be adjusted to meet the code, and that the width of
the lots be adjusted also. Commissioner Redford seconded the
motion; motion carries (5-0) with Chairman Munsch and
Commissioners Green, Johnson, Redford and Weaver voting in favor
of the motion.

Item 10: To consider approval of a Preliminary Plat for the Shadowridge
Estates Addition, Fourth Increment, located at the northwest
corner of Bethel School Road and Plantation Drive, at the
request of Centex Real Estate Corporation.

item before the Commission.
Following discussion Commissioner Redford moved to approve the
preliminary plat for Shadowridge Addition, Fourth Increment,

Commissioners Green, Johnson, Redford and Weaver voting in favor
of the motion.
Item 11: To consider approval of a Preliminary Plat for the University
Park Addition, located north of Bethel Road, west of Bethel
SchoOl Road and south of the Hunterwood Subdivision, at the
request of Joyce-Myers Enterprises.
Commissioner Green moved to deny the preliminary plat for the
University Park Addition. Commissioner Johnson seconded the

§ 212.01~. Additional Requirements for Certain Replats
(a) In addition to compliance with Section 212.014, a replat without vaca-
:~on of the preceding plat must conform to the requirements of this section fi:
(1) during the preceding five years, any of the area to be replatted was
limited by an interim or permanent zoning classification to residential use
for not more than two residential units per lot; or
(2) any lot in the preceding plat was limited by deed restrictions to
residential use for not more than two residential units per lot.
(b) Notice of the hearing required under Section 212.014 shall be given
before the 15th day before the date of the hearing by publication in an official
newspaper or a newspaper of general circulation in the county in which the
municipality is located and by written notice, with a copy of Subsection (c)
attached, forwarded by the municipal authority responsible for approving
plats to the owners, as indicated on the most recently approved ad valorem
tax roll of the municipality's governing body, of all lots in the preceding plat.
The written notice may be delivered by depositing the notice, properly
addressed with postage prepaid, in a post office or postal depository within
the boundaries of the municipality. If the preceding plat contains more than
I00 lots, the written notice shall be mailed only to the owners of lots located
within 500 feet of the lots to be replatted.
(c) If 20 percent or more of the owners to whom notice is required to be
given under Subsection (b) file with the municipal authority responsible for
approving plats a written protest of the replatting before or at the hearing, the
municipal authority shall require for the replatting the written approval of at
least 66'/3 percent of the owners of all lots in the preceding plat or of the
owners of lots located within 500 feet of the lots to be replatted if the
preceding plat contains more than 100 lots. In computing percentages of
ownership, each lot is considered equal to all other lots regardless of size or
number of owners, and the owners of each lot are entitled to cast only one
vote per lot.
(d) Compliance with Subsections (b) and (c) is not required for approval of
a replat of part of a preceding plat if the area to be replatted was designated
or reserved for other than single or duplex family residential use by notation
on the last legally recorded plat or in the legally recorded restrictions
applicable to the plat.
