RE: Preliminary Plat, Summer Place
Dear Mr. Sweeney:
Attached for your review and comment are: (1.) fifteen site
plans, (2.) fifteen preliminary plats, (3.) an application for
preliminary plat review, and (4.) a copy of our agreement with
the property owner to the west to solve the drainage problems in this
area.
As you know, this property has been before the P & Z and the
City Council several times in the past. However, drainage problems
in the area have always stopped development. With the agreement
attached and our subsequent filing of the appropriate insturments
to record the drainage and underground utility easement across the
property to the west, we should solve this problem.
I sincerely hope that we have addressed all the concerns that
the City might have regarding this request. If you need any more
information regarding this matter, please do not hesitate to contact

AGREEMENT
PARTIES: This agreement is made between the following:
1) EuGene L. Van Overschelde and Brenda L. Van Overschelde
2)
Summer Place - Coppell, a general partnership
comprised of Jim Jenne Enterprises, Inc. and
T.A.T., Inc., Jerry Hackler, President.
PROPERTY: The property involved is Lot 11 of Block A of
Cottonwood Estates in Coppell, Texas, Dallas County,
Texas.
TERMS OF AGREEMENT: EuGene and Brenda Van Overschelde
hereby agree to execute any and all documents necessary
to grant a 25 foot drainage and underground utility
easement to Summer Place - Coppell. Said 25 foot
easement shall run across the northern boundry line
of the above described property.
In return for granting the above easement, Summer Place -
Coppell agrees to level said property, and further to
cut an approximately one acre pond with a sloping bottom
to reach a maximum depth of 20 feet. Summer Place -
Coppell will also remove all excess dirt.
NON-PERFORMANCE: If after one year from the date the easement
is granted and filed, Summer Place - Coppell has not
substantially completed the promised work, then Summer
Place - Coppell shall either complete said work within
30 days or pay $3,000.00 in liquidated damages.
If EuGene and Brenda Van Overschelde shall not execute
the required documents granting said easement, then
Summer Place - Coppell shall be entitled to the legal
remedies of specific performance.
Any party to this agreement who must use legal means
to enforce this agreement and is successful in the
Courts, shall be'entitled to reasonable attorney
fees.
