RE: Smart Start School Addition, No. 1, Final Plat
Dear Mr. Jammal:
This letter is to inform you that the Smart Start School Addition, No. 1, Final Plat, to allow the development
of an 8,909 square foot day nursery on 1.65 acres of property located along the south side of Natches Trace
Drive, approximately 250' east of N. Denton Tap Road, was recommended for approval by the Coppell
Planning and Zoning Commission on Thursday, April 15, 1999, subject to the following conditions:
1)
An agreement being reached regarding the attached Non-Exclusive Recreational Easement
(attached).
2) The suggested wording in paragraph 2 of the agreement be placed on the face of the plat.
In addition, a minimum of 20' needs to be provided for proposed off-site sanitary sewer easement.
The date scheduled for consideration by the Coppell City Council is Tuesday, May 11, 1999, at 7:30 p.m. A
representative for this case must be present at this meeting. Failure to represent this item may result in the
denial of this application. City Council has instructed staffto include in its agenda packets only those items which
accurately reflect conditions as recommended by the Planning and Zoning Commission. The submittal deadline
for revised drawings is 12 noon, Wednesday, April 28m. Therefore, please submit 17 folded copies of the
revised drawings, plus three (3) 8 1/2 x 11 paper reductions on or before that date.
The drawing which requires change in order to comply with the Planning and Zoning recommendations is: Final
Plat.

RE: Non. Exclusive Recreational Easement
Dear Mr. Anderson:
Please be advised that on behalf of thc City of Coppell we have reviewed the Hon-
Exclusive Recreational Easem,ent for property owned by the Denton County Levee Impwvement
District No. 1 (L.I.D.).
In reviewing this instalment, we are concerned abote the non-exclusive nature of the
easement. It is the City's pos/i/on with regard to taking an easement for the purposes of
pwviding a walking and bike trail and amenities relative thereto, thai the Grantor would have the
tight and retain the right to implement other easements which would interfere reasonably or
unreasonably with the use and maintenance of the City. We would by immutable to chaaging
paragraph 2 to read as follows:
"The easement fights and ptivileSes granted haz~i= are exclusive except
that the Grantor reserves and retains the fight to use the easement tract t'or
all ptuposes which do not unreasonably interfere with the ri~ts lp'ante~.
herein."
With this minor change, we would be mote comfortable with talcing possession and
spending tax money to make these 'improvements and ensure that there is no unreasonable
interference.
