Subdivision Entry Features - Shadow Ridge Estates
As a part of the original construction of this subdivision a verbal
request was made by City Council and honored by the developer to provide
the entry sign, walls, landscaping and streetscaping that exist along
Bethel School Road and Plantation.
The developer also installed the ornamental lighting and brick pillars
at the bridge on Bethel School Road as well as the entry walls.
Maintenance of th{s area has been a collective effort on the part
of the primary home builder Fox & Jacobs, the residents and the City
within their Right-Of-Way. This has not been efficient nor equal
as the City on several occasions when requested has worked on all
areas.
For the major portion these features are located outside the
Right-Of-Way on private property. This has been the primary factor
in how the area is maintained as when City employees go beyond their
R.O.W., a trespass occurs.
It is for this reason City forces have kept these to a minimum standard
of maintenance.
Under a currently proposed development which will plat the west side
of Plantation the owner is not willing to put in place a homeowners
association to maintain the features on their property. The owners
representative is willing to provide an easement to the City for
maintenance purposes.
Staff does not desire to keep these features in place as in some cases
they are deteriorating to unacceptable levels and will require
unbudgeted resources to bring them to acceptable levels, i.e. the
entry walls.
There are those features within identified R.O.W. such as the bridge
lights, an irrigation system and landscaping that Staff wishes to
remain in place by relocating the controlling mechanism and
infrastructure to the R.O.W..
Staff wishes to recommend the developer either maintain those portions
on their private property or remove them and the City to relocate
the items it desires to remain withing R.O.W. at their (Cen-Tex's)
expense.
Also, Staff believes that with enacted ordinances and the Streetscape
Plan it is not possible to require the developer to form a homeowners
association to maintain the existing amenities on this development.
I am providing this to you to make you aware of this situation as
it is currently being discussed through the DRC process.
