The deed restriction you mentioned was discussed and a suggestion
of Public Works at a Director's meeting. Public Works is not working
with Larry Jackson on this issue as it affects one lot and
organizationally falls under Planning & Zoning, Engineering or Building
Inspections. It is further suggested that Dale Jackson as the Building
Official certify the fence placement and acknowledge the deed
restrictions use as this occurs on private property thus is not
maintained/operated by the City.
Should Dale feel this inappropriate a survey of surrounding communities
procedures in this event may substantiate the role he should play
as the author and enforcer of this deed restriction.
I am not responsible for private property and my scope of responsibility
would not include this matter. This is a matter more directly in
your responsibilities as Planning and Zoning Coordinator. This does
not involve a Streetscape issue and is required by the Zoning Ordinance
which you administer.
Public Works is willing to assist in those areas where appropriate
but this is not in an area of that type.
