Box 478 Coppell, Texas 75019 Re: Taco Bell Addition I:iZI Job No. 02-0285-01 Dear Members of City Council: On October 10, 1995 City Council voted to ratify, by City of Coppell Ordinance, the Special Use Permit granted to this site. The Ordinance No. 91500-A-107 passed on that date indicated specific special conditions attached to approval. These conditions included Section 2, Paragraph 7 which states "The monument sign shall be eight feet high, 60 square fee~ in area, with a brick base, and a setback of 72.5 feet, and shall be constructed in accordance with the Monument Sign Elevation Plan attached hereto as Exhibit "D'"'. This Special Use Permit was originally reviewed by the City of Coppell Planning and Zoning Commission on April 20, 1995. The P & Z recommended approval of the Special Use Permit with conditions. They were aware of the application for variance on the monument sign location on site and could have but did not make Specific comments about the sign at that time. At the May 9, 1995 City Council public hearing for this project and subsequent discussions at the meeting this specific monument sign size and area was suggested by members of Council and ultimately agreed to by Taco Bell representatives present at the meeting. We agreed to this compromise fi.om our larger submitted size which was in accordance with the then and still present City of Coppell Sign Ordinance. This project has gone forward in good faith with the current Ordinance approved monument signage and we have based all of our business projections on this approved signage remaining. We are hopefi~l that Council will also go forward in good faith with the continuation of this approval. SECTION 2. That the change in zoning .for Special Use Permit to allow the operation of a drive-through restaurant, is hereby granted subject to the following special conditions: 1. The property shall be developed and used only in accordance with the Site Pl~n~ Exterior Elevations Plan; Mow_~ment Sign Elevation, Irrigation Plan and Landscape Pl~n~ attached hereto as Exhibits "B', 'C', 'D', ~E~ and ~F', respectively. 2. The brick facing shall closely match the color of the Woodside Village shopping center. 3. The concrete roof tiles shall be a neutral shade, preferably a gray within a color range from a highly-muted slate hue, poss~ly with a greenish cast, to a highly muted earth tone with a brownish tinge. 4. The awning material shall be a solid neutral color within a color range from off-white to gray. .. 5. The exterior p~inted surfaces shall be of a solid neutral color within a color range from off-white to gray. 6.The raised rims of the tower caps and entry portals shall be of the s~me brick as the building face. The mon~ment sign shall not exceed 60 square feet, with a maxim,~m height of eight feet, including the brick base and a setback of 72.5 feet, and shall be constructed in accordance with the Mon-ment Sign Elevation Plan-attached AGGOgO~I heret//'~ Exln"uit 8. The hours of operation for the restaurant shall not be later than 12 midnight, Monday through Sunday. SECTION 3. That the Site Plan~ Exterior Elevations Plan; Monment Sign Elevation Plan, Irrigation Plan, and the Landscape Plan as shown in Exhibits "B", "C', "D", "E" and "F", attached hereto and made a part hereof for all purposes, be, and the same are hereby, approved. SECTION 4. That the above property shall be used only in the wanner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and as amended herein. SECTION 5. That all provisions of the Comprehensive Zoning Ordinance of the City of Coppell, Texas, in conflict wi~ the provisions of t_his ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. . SECTION 6. That should any sentence, paragraph, subdivision, ciause, phrase or section of this ordinance be adjudged 'or held to be unconstitutional, illegal or invalid, the .. same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the C6mprehensive Zoning Ordinance as a whole. SECTION 7. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Comprehensive Zoning Ordinance,as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. -
