Dear Kevin:
Through our attorneys we have received a request from Thompson & Knight for a certification
under Section 212.0115 of the Texas Local Government Code. While the City is making every
effort to facilitate your project and will issue building permits for a phased development on the
platted 9.88-acre tract, the City cannot issue the certification requested.
There are probably half a dozen different ways to satisfy the legal requirements of your lenders,
your future lenders, Randall's, Randall's lenders, if any, the City and the State. For example,
the front parking lot functions as a common area, since each party has cross access and cross
parking agreements. Have you considered having Randall's and Coppell Town Center, L.P.,
designate the parking as common area? If it were platted as a common area, landscape buffers
against property lines would not be an issue.
A sketch follows to show how three lots, each with frontage on East Sandy Lake Road could be
established in association with a common area, and satisfy City requirements. It is only a
suggestion. If you would like to offer other solutions, we will be glad to consider them, because
we are as interested as you are in solving the problem.
