DeForest Road is a local street currently paved with asphalt. It presently has a 40-foot right-of- way to which this developer will add ten feet of dedication. Item # 12 SURROUNDING LAND USE & ZONING: North-Denton Creek, vacant; "A', Agriculture South - single family residences; PD- 137 East - single-family residences; PD-131 West -municipal service center; "A", Agriculture COMPREHENSIVE PLAN: The Comprehensive Plan shows the property as suitable for residential uses. DISCUSSION: This is the final procedural step in the ultimate development of this 15-acre parcel. Although the zoning which was granted allowed 31 residential lots, the final plat submittal has reduced that total to a 28 lot subdivision. With the restrictive covenant agreed to by the developer regarding no fill and no build on the 20 foot west easement and 30 foot east easement, the hiring of an arborist to preserve trees with Leisure Services input, ingress/egress during construction along Bristol Court only, a corner clip at the intersection of Stratford Lane/DeForest Road, and placing the finished floor elevations on all lots, this final plat addresses the requirements placed on the preliminary approval. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Staff recommends approval of this final plat with the understanding that all conditions of the preliminary plat (see attached June 13, 1997 letter of preliminary plat approval) are followed, the $1285 park fee is paid, and entrance design is approved by the Fire Department. This statement must also be reflected on the Final Plat and in the Deed Restrictions and Covenants of the Homeowners Association. This Restrictive Covenant must be reviewed and approved by the City Attorney. Failure to reference the project number may result in a delay. We have reviewed this project in accordance with Section 404 of the Clean. Water Act and Section 10 of the Rivers and Harbors Act of 1899. Under Section 404, the U. S. Army Corps of Engineers (IJSACE) regulates the dischaz~ of dredged and fill material into waters of the United States, including wetlands. Our responsibility under Section 10 is to regulate any work in, or affecting, navigable waters of the United States. Based on your description of the proposed work, and other information available to us, we have determined tha~ this p~oject will not involve activities subject to the requirements of Section 10. However, this project will involve activities 'subject to the requirements of Section 404. Therefore, it will require Department of the Army authorization. We have reviewed this project under the notilS~on procedures of Nationwide Permit General Condition 13 ~~, Vol. 61, No. 241; Friday, December 13, 1996). After full consideration of resource agency commen~, we hitv¢ determined that this project is author/zed by nationwide permit 26 for Headwaters and Isolated Waters Discharges. The special condition for this permit is as follows: 1. The permit-tee shall develop, implement, and abide by a detailed mitigation plan to compensate for unavoidable adverse project impacts to waters of the United States. The permit'tee shall provide this mitigation plan to the Re~latory Branch, Fort Worth District, USACE for review, and receive USACE approval prior to commencing any ground disturbing activities within the permit area. The pemfittee shall not proceed with implementation of the plan until it is approved by the USACI~. The permittee shall implement the mitigation plan approved by the USACE concurrently with the construction of the project and complete the in/tit! construction and plantings associated with the mitigation work pr/or to the completion of construction of the project. Completion of all elements of the f'maI mitigation plan is a requirement of this permit. The mitigation plan shall, at a miaixnum, include the following features: a. a detailed design, including cross section and plan view drawings, of the created and enhanced wetland mitigation axeas; b. minimum plant survival criteria; c. a maintenance plan for the mitigation area, with an emphasis on mini_mai to no disturbance of created and enhanced wetland areas; d. a Performance standard for all mitigation areas; e. a'perpetual deed restxiction for the mitigation area; and ' f. a moMtoring and reporting plan. Failure to comply with these specifications and conditions invalidates the authorization and may result in a violation of the Clean Water Act. Our verification for this activity under nationwide permit 26 is valid until nationwide permit 26 expires on December 13, 1998. If you commence, or are under contract to commence, this activity before December 13, I998, you will have twelve months from that date to complete the activity under the present terms and conditions of nationwide permit 26. Continued confirmation that an activity complies with the specifications and conditions, and any changes to the nationwide permit, is the responsibility of the permittee.
