Dear Mr. Dooley:
Please accept my apology for the confusion I expressed in the City of Coppell Development
Review Committee meeting of April 4, 1996. It stemmed from the fact that the earliest
appearance of the Town Center District in a published Zoning Ordinance Book as found on our
library shelves was an ordinance enacted on December 8, 1983. That ordinance listed grocery
stores as allowable only by Special Use Permit in the "R" Retail District and "C" Commercial
District. That ordinance also listed the uses permitted in the "TC" Town Center District as
those permitted in the "O" Office District, those permitted in the "R" Retail District and all but
twelve uses permitted in the "C" Commercial District. When Jared Jackson, of Dowdey
Anderson and Associated, disputed my assertion, I agreed to research the matter further.
On researching the records in the City Secretary's office, I found Ordinance 204-A-15 enacted
on June 8, 1982. This ordinance created the original TC District. No doubt you would have
a copy at your fingertips, since it relates specifically to your client's property, but we would
have no particular reason for having immediate access to a fourteen-year-old unpublished
document.
After reading Ordinance 204-A-15, I agree that the original TC District did not require a Special
Use Permit for a grocery store. I am sorry that I did not know that on April 4, and I apologize.
