Among the documents that your office furnished to Mr. Hinckley was a letter dated May 1996 from Pete Smith to Jim Witt giving an opinion that lots in Town Center are subject to perimeter landscape requirements and that a lot line which transverses a shared driveway (such as this) is subject to a landscape area of at least 10 feet in width on each side of the driveway. In the August 20, 2001 letter you provided me, this time from Art Anderson to Robert Hager, the applicant indicates he believes they are not subject to this perimeter landscape requirement based on Council's approval of the adjacent bank site, and they are not planning to seek relief from the BOA with respect to this issue. I have made Mr. Hinckley aware of all of this and he indicates he prefers not to amend his variance request to address the perimeter landscape question. In my reading of the comments resulting from the August P and Z meeting, it appears that the issue of a perimeter landscape buffer was never addressed as an item. The letter references only the condition of an off-site landscape variance approval. My concern is that if this perimeter landscape buffer issue is now raised at the Council meeting, Mr. Hinckley will most likely have to seek an additional variance if he wishes to proceed with his development. At this time I do not know how to fix this from my end, but if there is this concern we should try to address it now instead of waiting until it is in front of the Council and having to send an applicant back thru the system.
