Payment Under Protest
Dear Ms. Morris:
Enclosed is a check for $101,991.00 for payment of Construction Permit
and Water and Sewer Availability Fees for the subject project. These
fees were calculated by John Wankum of Ginn and Associates under the
fee schedule which was in effect until May 28, 1985. These fees are
being paid under protest, since we believe that fees on this plat should
be calculated using the fee structure adopted on May 28, 1985. We
understand that payment of these fees is required in order to proceed
with utility construction.
The fees determined by Mr. Wankum are shown below:

Notwithstanding our objection to the method of calculation of fees, we
request a refund of 50% of the difference between the fees that we, as
the land developer, would be required to pay under the fee structure
passed on May 28, 1985, and those that we are now being required to pay
in order to proceed with this development.
My calculation of the refund due is shown on Exhibit 1.
