Final Plat Dear Derek: On Thursday, February 20, 1997, you requested a release of the above-referenced plat for filing, although the third condition of our October 9, 1996, correspondence (copy attached) had not yet been met. As you know, the City does not normally allow the filing of a plat until all conditions have been complied with. However, because of the nature of your request and the following factors: · It is an eight-lot subdivision; · all lots are currently owned by Centex, with no immediate plans to sell; · the Home for the Future is to be constructed on one of these lots and the lead time required to construct this home necessitates expedited processing, and · a total of four lots will be built upon initially, I agreed to seek the advice of our legal counsel regarding its filing. Although initially reluctant to endorse your request, our attorney finally agreed to the filing provided the following condition is submitted to us by Centex in writing: The City will allow this plat to be recorded, but Centex recognizes that no Certificates of Occupancy will be issued nor occupancy by permanent residents will be allowed before the HOA deed Restrictions/Agreement has been approved by the City Attorney. In addition, a draft copy of the HOA must be delivered to our City Attorney on or before March 10, 1997. With that agreement in hand, we will release the plat for filing and allow development to proceed on Vistas of Coppell, Phase HA. F'mal Plat Dear Sirs: This letter is to inform you that the Vistas of Coppell, Phase HA, Final Plat, to allow the development of 8 lots of the proposed 126-1ot residential subdivision located approximately 2500' west of MaeArthur Boulevard, along the south side of Spur 553; north of Denton Creek, was approved by the Coppell City Council on Tuesday, October 8, 1996, subject to the following conditions: 1) Place on face of the Final Plat as well as in the Homeowner Deed Restrictions/Agreements the following: "As a part of all executed monetary contracts, a disclosure letter must be given to home buyers indicating the following information: a. The development is located along the State Highway 121 Bypass. b. Due to the proximity of D/FW and Love Field airports, there may be occurrences of ambient aircraft noise due to aircraft overflights. c. The tax impact of the Levee Improvement District." 2) Compliance with Engineering and Fire Department comments as follows: a) Provide off-site casements for sanitary sewer and water. b) Provide a temporary turn-around at the end of the street for Fire Department apparatus. 3) The Homeowner Deed Restrictions/Agreement is approved by the City Attorney prior to the recording of the plat. Staff would also like to remind you that Park fees will be assessed on the eight lots for the construction of a Hike and Bike Trail. Please be advised that no construction may begin until this Final Plat has been filed with the Dallas County Plat Records Department. Approval of this Final Plat is valid for six (6) months. If it has not been fred for record with the County prior to April 8, 1997, the Final Plat shall be deemed null and void and resubmittal shall be required.
