RE: Westbury Manor Homeowners Association
Dear Ms. Moro:
Please be advised that we have reviewed the Declaration of Covenants,
Conditions and Restrictions for Westbury Manor, along with the bylaws of the Westbury
Manor Homeowners Association, Inc., in reference to the approval of the plat.
After reviewing the same, it has come to our attention that the Declaration of
Covenants, Conditions and Restrictions provide for City enforcement of the necessary
common areas which are to be maintained by the association under 3.25 and 3.26. As
such, despite the fact that this is a little different than we normally encounter, we are in a
position to approve the Declaration of Covenants, Conditions and Restrictions for
Westbury Manor. My 0nly question would remain is if the staff is satisfied that the areas
identified as common areas of City interests, is sufficient on the dedicated plat to ensure
that these areas are properly maintained by the Association and by the City if the
Association fails to undertake the proper maintenance of the same. Assuming it meets
with the staffs approval concerning the coverage of the "common areas" and the
"common areas of City interests," we are in a position to acknowledge approval of these
homeowners association covenants and bylaws.
