153 Simmons Drive (Sandy Oaks Addition)
On Thursday, May 24, 2001, I received a phone call from Mr. Byron Hardin, a resident
living at 153 Simmons Drive. Mr. Hardin informed me that he had received his current
property tax bill and was upset that he is responsible for the taxes on a portion of his lot
that he can not use. The area of concern is a 5' strip of land located to the rear of Mr.
Hardin's property, actually beyond the 20' Utility and Alley Easement (See attached
survey). Mr. Hardin explained that Ryland had constructed homes (Westbury Manor)
behind his property and that Ryland did not get permission to "take" his, or any of his
neighbors' property, but proceeded without permission.
Mr. Hardin informed me that the City (Deputy City Manager, Engineering, and Building
Inspections) had previously been involved with this case and that nothing has been done
to correct the situation. He is again coming to the City for assistance in remedying this
situation.
