Dear Randy:
In your letter dated August 28, 2000, the Creekview Homeowners Association Board
alleged I was "in violation of Coppell City Ordinance Sec 8-3-5, which prohibits parking
vehicles in excess of one and one-half tons on a residential lot."
I responded to your allegation in September. After reviewing the Ordinance you cited I
concluded I was not in violation. I stated specifically the section I was in compliance. As
a further clarification, I went to different city departments to have my circumstance
reviewed. After reviewing some paperwork we ail concluded I was in compliance. The
CHAB (or the individuals it represents) seems to have a different opinion and ask me to
furnish the CHAB with city approval and/or permits, as this will provide the CHAB with
the "documentation to defend my right to do so."
I did not ask the CHAB to defend my rights or represent me. I did ask the CHAB for the
names of Realtors and individuals raising the objection to the vehicles. I stated I wished
to discuss this issue directly with them, as a neighbor should. I also stated the neighbors I
did talk to included the Algiers, Catys, Coy, s, Diebals, Goldblatts, Harts, Heppes, Majors,
McCarthys, Menas, Medinas, Pattersons, Plettas, Taylors, Tanners, Savages, Spaldings,
Von Strobes, Wests, Wikmans, and Wolfs, all do not see a problem. Further, I have
talked to past CHAB members; they did not see a problem. I also stated in the year and a
half I have had the track not one person has called to complaim
I understand the CHAB has certain responsibilities. After I reviewed the By-Laws of the
Homeowners Association, I found nowhere is the CHAB restricted to furnishing me the
names of the residents and realtors who raise an issue. I have a right granted to me by the
Bill of Rights. The right to face my accuser. Another statue gives me additional rights.
Under the Freedom oflnformation Act, I can ask a corporation for certain information.
The information I am requesting the Creekview Homeowners Association is for any
information it has about uny and ail complaints regarding the residence of 158 E Bethel
Road, Coppell, TX. I ask for the names of the individuals and realtors.
Again I wish to talk to the individuals and realtors raising the objection so I may fred out
the real issue, discuss, resolve and/or compromise with them. I do not need or want the
CHAB to represent me. Let's get the issue resolved with the individuals and realtors
complaining. I want to resolve the issue.
In further review of the By-Laws, I did not see where the CHAB is empowered to enforce
City Code. I would hope my dues are not being used for reasons outside the scope they
where designated for.
I also asked the CHAB for copies of other actions the CHAB bas taken. I was stunned to
fred only one. Yet, when I drive around the neighborhood I notice several violations,
some even city codes. These include vehicles in excess of the speed limit, unpainted
fences (your own house), basketball nets, woodpiles, satellite antennas, unbrieked
mailboxes, exterior sheds, tracks with commercial decals, garage doors opened, watering
on wrong days. Do I need to go on? Are these not your responsibilities? I do believe you
told me the CHAB chooses to table some of these issues. Yet my vehicles are in
compliance, and the CHAB chooses to further harass me. At some point you will force
me to hire an attorney to defend my rights. We are not far fi:om that.
Let me know when the next CHAB meeting is, as I wish to become more active in the
decisions of the CHAB.
Since you bave copied certain city officials, I will do the same. This will keep them up to
date on our difference of opinion. Yet, is the difference with the CHAB or the unnamed
individuals it chooses to represent?
