and the City of Coppel], Dallas County, Texas, being more particularly
descriDed as shown on this pIat of Lot 3 Block !. Fellowship of tas
Colinas Addition and as tha Subject Property of the City of Grapevine
zoning Casa CU 93-07; and
WHEREAS, 5uD~ect Proparty is located within closa proximity of
the Dallas-Fort Worth International AirDort ('D/FW') and is sub)ect to
aircraft noise and othar noise and aircraft overflight duo to such
location; and
WHEREAS, Grantor has processed said zoning case and subdivision
plat through the procedural process requirad under the City of
Grapevine's ordinances: and
WHEREAS. Grantor has retained the services of professional noise
consults to evaluate the impact of the noise on the Subject Property
and any subsaquent development due to the proximity of D/FW to 5ub)ect

This instrument does not release the owners or operators of
aircraft from liability for damage or injury to person or property
caused Dy failing aircraft or falling physical Objects from aircraft,
except as stated herein with respect to noise, fumes, dust. fua] or
luDricant particles.
It is agreed that this Release shall be binding upon said
Grantor, its successors ahd assigns in interest to said property; and
it is further agreed that this instrument shall be a Covenant running
with the ]and, and shall be recorded in the Beed Records of Tarrant
County.
Grantor does hereDy acknowledga that tha Subject Property's
proximity to O/FW will result im aircraft and other noise both outside
of any Duildings and structures and inside any bui]d~ngs and
structures and that the use of Subject Property for church and other
purposes encompasses uses that will be impacted and effected by said
noise, This fact is noted in a report entitled · Acoustical Study for
Proposed Development at State Highway 12~ North of 8ethel Road.
Grapevine. Texas' Dy doiner Rose Acoustics dated duly 1993' (Joiner
Report). which report was prepared for Grantor. is on fila in tho
official public records of the City of Grapevine relative to Zoning
Case CU 93-07 and is incorporated Dy reference in its entirety in the
body of this easement and release and in a report for the City of
Grapevine by Harris Hiller Hi]]er ~ Hshson. Inc. dated August 11. ~993
{Harris Report). which report is in the puDlic records of the City of
Grapevine for Zoning Case CU 93-07 likewise acknowledged Dy Grantor
and is incorporated into the body of this easement and re]easo.
Grantor does hereby agree to the following acknowledgments.

and the Harris ReDorts:

independent acoustical consultant satisfactory to The City
of Grapevine, which approval will not be unreasonably
withheld, who shal! certify to the City that proposed
construction plans are sufficient and adequate to prevent
aircraft noise levels from being more than 10 db above the
NC values called for in the doiner Report:
6) As a condition precedent to the issuance of certificates of
occupancy on any buildings or structures, the 6rantor shall
retain the services of a qualified ~ndspendent acoustical
consultant, satisfaotory to the City of 6rapevine which
approval will not be unreasonabIy withheld, to conduct post
construction tests and certify that the noise reduction (NR)
attenuation requirements to prevent aircraft noise levals
from being more than i0 db abova the NC valuas called for in
tha doiner Report have been met.
Grantor. its successors and assigns do hereby release, relieve,
quit cIaim, hold harmIess and inOemnify the City of Grapevine, zts
City CounciI. officers, agents, employees and servants for any and all
damages, injuries, claims, causes of action, lawsuits, inverse
condemnation claims and any claims whatsoever arising out of or
connected in any msnner with the approval of zoning Case CU 93-07,
approval of the north Port Business park subdivision plat, issuance of
any building or other permits and any certificates of occupancy which
release and indemnify shall includa all costs of court and attorneys'
fees.
