required.

TRANSPORTATION:
Denton Tap Road is a P6D, six-lane divided thoroughfare
contained within a 110-120 foot right-of-way. Fitness Court is a
local commercial street with variable right-of-way.
SURROUNDING LAND USE & ZONING:
North - parking lot; C (Commercial)
South - access drive, fire lane; C (Commercial)
East - parking lot, restaurant; C (Commercial)
West - parking lot, Everybody Fits gymnastics facility; C (Commercial)
COMPREHENSIVE PLAN:
The Comprehensive Plan of May 1996 shows the property
as suitable for neighborhood retail of which this use is
appropriate.
DISCUSSION:
This is the companion piece to the zoning request for a Planned
Development district for a ballet studio. This is a pretty straightforward
case, and only minor revisions need to be made. As indicated with the
zoning application, a condition of approval of this plat will require
obtaining permission from the property owner to the south to extend
driveways/firelanes into this parcel. Absent that, Fire Marshal approval
of alternate fire protection will be required. There are also some
Engineering concerns that are included as an attachment to the request.
RECOMMENDATION TO THE PLANNiNG AND ZONING COMMISSION:
Staff recommends APPROVAL of this Minor Plat subject to the
following conditions:
1. Obtain written permission from property owner to the south
to extend driveways/firelanes into their property. If
permission cannot be procured, approval of the Fire
Marshal of alternate fire protection is required.
