This letter shall serve to confirm our conversations of earlier today concerning
the property near the intersection of Denton Tap Highway and Highway 121.
As you and I discussed, we represent the out of state owner of the parcel which
we purchased from Centex. My client purchased the frontage both along the side
street with the middle school and along Denton Tap Highway. The only portion my
client did not purchase is the comer itself which has been retained by Centex.
My client purchased the property when it was zoned light industrial. Our
purchase is an investment-backed expectation with the intention of selling the
property consistent with the current zoningi' Prior to any notification whatsoever fkom
the City of Coppell that a change of zoning was being proposed, we entered into two
purchase agreements to sell those portions of the property which frorLt on the side
street containing the middle school. One of those contracts is for use as a Jack-In-The-
Box and will not be affected by the proposed change of zoning. The other contract,
however, is for a public storage facility and is a use specifically prohibited under the
new zoning. The change of ~oninS' would cause a severe loss to my client by making it
impossible for my client to deliver under the terms of the agreed upo:a purchase
agreement. Attached is a redacted portion of the contract with regard to the public
storage fhcility. As you can see, the contract was executed prior to m~y notices
concerning change of zoning.

In addition, we have some concerns regarding set backs as to the frontage aJoz~
Denton Tap. As you discussed this morning, our concerns may be alleviated by the
particular provisions of the new zoning that will apply concerning lar~d use.
I believe, based upon our conversations, that it is possible that my client and
the City may be able to work out arrangements acceptable to all parties concerning
the use of this piece. However, since I am leaving on vacation tomorrow morning and
will be out of town until next week, I do not believe it is possible to conclude these
arrangements prior to the schedule city counsel meeting on August 8 2000.
Accordingly, we hereby request that the city counsel hearing on the proposed
change of zoning be postponed from the August 8, 2000 meeting to the first zoning
meeting in September. I understand that you have spoken with the applicable people
at your client and that such request will be granted. We are asking that Mr. Burmell
attend the upcoming meeting on August 8th since he made the presentation at the last
zoning hearing. If this request will not to be granted, please ask my ,)ffice to contact
me on vacation so that we may take such action before Au~st 8=~ as ~ve deem
necessary in order to protect our client's economic interest in the existing contracts
concerning the property.
