I visited the site this weekend and discussed this with our city attorney. ,~,t this point in time, they are still in
compliance with the zoning regulations because they have not occupiedlthe club house for a leasing
office. Please keep us informed if this situation changes, and we will cor~tinue to monitor from here.

As City Attorneys for the City of Coppell, Texas, we are writing to you regarding
The above-referenced properly We have received information that your company intends
to operate a leasing office in the clubhouse of the common property. We have reviewed
the zoning in Planned Development 182 and determined that a l~asing office is not an
allowed use in this planned development Therefore, any operati~on of a leasing office
consistent with the information we have received would be a violation of the zoning
ordinance. If such activity occurs, we would be forced to take enfol'cement action.

Marci - An impromptu meeting was called last evening by Woodmar Real Estate management
company to advise existing homeowners of the following:
- Liberty Townhomes Venture LLC (Developer) had transferred own :rship of the vacant land on the
property titled Phase III and Phase IV to Colonial Townhomes Ventu re LLC - however, the same
principals are in ownership. :
- It is the intent of Colonial Townhomes Venture LLC to cease sales >ftownhomes and pursue lease
rentals for the balance of the townhome units.
- Colonial Townhomes Venture LLC had filed a petition with the Zo~
to "expand" the clubhouse, which has been approved. However, ther
there is an exercise room. We have been advised that the structure th

- The existing homeowners were NOT given notice of the transfer of
the Homeowner's Association, nor the establishment of a new Home

regulations in the City of Coppell and have not been conducting business in accordance with State of
Texas Statutes, Property Code, Chapter 204
We are requesting that your office investigate the legality off
- Colonial Townhomes Venture LLC taking our common area prope~y for the sole purpose of their
profit.
- Colonial Townhomes Venture LLC, aka Liverty Townhomes Vent[ re LLC, making explicit claims
during the sale sol existing townhomes, that this is a dedicated town~ ome community, and now
intending to lease 62% of the townhome units.
