Development Requirements: (TO BE EFFECTIVE DURING THE TIME PERIODS INDICATED HEREIN) 1. No building or structure shall be erected except f~3r solid masonry walls and related landscape improvements as shown on the Detail Slte Plan attached hereto as Exhibit A. 2. No driveways will be constructed across either i Tract 1 or Tract 2 providing access from the adjoining property described on Exhibit B las Tracts 3, 4, and 5 hereto to Coppell Road other than driveways accessible for emerge~hcy purposes only, as may be required by the City of Coppell in connection with the ~Jevelopment of the adjoining propert3t. 3. At such time as any building permit shall be issued for erection of a building or structure on the adjacent land described on Exhibit B as! Tracts 4 and 5 attached, the Owner of Tract I shall be required to construct the solid masonry wall and related landscaping improvements located on Tract 1 as shown on the Detail Site Plan attached as Exhibit A prior to the issuance of a certificate of occupancy in connection with such building permit. The City of Coppell shall have the right t~ enforce such requirement by an injunction action, without prejudice to or limitation of any other relief the City of Coppell may have. 4. At such time as any building permit shall be issued for erection of a building or structure on the adjacent land described on Exhibit B Tracti 3 attached, the owner of Tract 2 shall be required to construct the solid masonry wall and related landscaping improvements located on Tract 2 as shown on the attached Detail Site Plan prior to the issuance of a certificate of occupancy in connection with ~uch building permit. The City of Coppell shall have the right to enforce such requirement I~y an injunction action, without prejudice to or limitation of any other relief the City of ColTpell may have. 5. The above requirements shall apply with respecti to Tract 2, effective from the time the adjoining land described on Exhibit B Tract 3 herpto shall be zoned "LI" by the City of Coppell and shall continue in effect until such time a~ the land described on Exhibit B Tract 3 or any portion thereof shall be, without the con~ent of its then current owner, rezoned to any designation other than LI, at which time the above restriction shall cease to apply to Tract 2 and any use permitted in the L! Zoning District shall be permitted with respect to Tract 2. 6. The above requirements shall apply with respec~ to Tract 1, effective from the time the adjoining land described on Exhibit B Tracts 4 and ~ hereto shall be zoned "MF-2" by the City of Coppell and shall continue in effect until sucl~ time as the land described on Exhibit B Tracts 4 and 5 or any portion thereof shall be rezQned, without the consent of its then current owner, to a zoning designation other than MF-2, at which time the above restrictions shall cease to apply to Tract 1 and any use permitted in the MF-2 Zoning District shall be permitted with respect to Tract 1. 7. The owners of Tract I and Tract 2, from time td time, shall be responsible to maintain, at their cost, the landscaping improvements established within Tract 1 or Tract 2, as the case may be, including all irrigation improvements established within each such tract. 8. The improvements to be constructed by the o~vners of Tract I and Tract 2 pursuant to the provisions of Paragraphs 3 and 4 above a 'e intended to be in lieu of any assessments against Tract 1, Tract 2, or the land describe d on Exhibit B Tracts 3, 4, and 5, for any subsequent improvements to Coppell Road and Bethel Road and the City of Coppell releases the owners of such land from any liability for subsequent assessments f:\...\cor r94\coo pell.421 21ADr94 with respect to Coppell Road or Bethel Road, and from any requirements that costs of improvements to Coppell Road or Bethel Road be paid as a condition to plat approval with respect to the land described in Exhibit B Tracts 1, 2, 3, 4, and 5. 9. No building permit may be issued with respect t(~ any development of the land described on Exhibit B tracts 4 and 5 until the owner thereof! has caused Freeport Parkway to be extended from Bethel Road to Ruby Road and to be paved for at lease half of its width as shown on the current City of Coppell Thoroughfare Plan. No access shall be permitted from Exhibit B Tract 4 and 5 to Bethel Road other than access for emergency purposes only, as may be required by the City of Coppell in connection with the development of Exhibit B Tracts 4 and 5. Such requiremer~ts shall cease to be in effect if the proposed alignment of this section of Freeport Parl~vay as shown on the City of Coppell Thoroughfare Plan is eliminated or substantially rrlodified. 10. In connection with any subsequent platting of tile land described in Exhibit B Tracts 4 and 5 for multi-family residential development, a portion of the approximately 4 to 5 acre tract shown on Exhibit C (the land shown on Exhibit C being taken out of the land described in Exhibit B Tracts 1, 4, and 5) equal to one (11) acre for each 100 proposed dwelling units and located adjacent to Coppell Road stta~ll be dedicated to the City of Coppell/or park purposes and the City of Coppell agrees to accept such dedication in satisfaction of all requirements pursuant to Ordinance No. 93627, or any subsequent park dedication ordinance with respect to the land described on! Exhibit B Tracts 4 and 5.
