On August 8, 2006, the Coppell City Council unanimously approved a change of zoning from LI
(Light Industrial) to PD-215-LI (Planned Development-215-LI), to allow the development of a 4,248-
square-foot convenience store, 1 ,414-square-foot restaurant and a 5,1 04-square-foot canopy over six
gas pumps on 1.68 acres of property within the City of Coppell and an additional 0.66 acres of lease
area (DFW Airport Land outside of Coppell City Limits) located south of LBl (IH 635), east of Royal
Lane.
Attached you will find a copy of Ordinance No. 915-A-437, which was approved by Council and
signed hy the Mayor on September 12, 2006.

AND PROVIDING AN EFFECTIVE DATE.
\VHEREAS, the Planning and Zoning Commission and the governing body of the CIty of
Coppell, Texas, in compliance with the laws of the State of Texas and pursuant to the
Comprehensive Zoning Ordinance of the City of Coppell, have given requisite notices hy
rubllcation and othenvise, and after holding due hearings and affording a full and fair hearing to all
property owners generally, and to all persons interested and situated in the affected area and in the
\Icinlty thereof, the said goveming hody is of the opinion that Zoning Application No. PD-215-Ll
should be apprO\ed, and in the exercise of legislative discretion have concluded that the
Comprehensive Zoning Ordinance and Map should be amended.
~OW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppell,
Texas, duly passed by the goveming body of the City of Coppell, Texas, as heretofore amended, be

and the same is hereby amended to grant a changc in zoning from LI (Light Industrial) to PD-215-
LI (Planned Development-21S-LI), to allow the development of a 4,248-square-foot convenience
store. 1 ,4l4-sq uare- foot restaurant and a 5,1 04-square- foot canopy over six gas pumps on 1.68
acres of property within the City of Coppell and an additional 0.66 acres of lease area (DF\V
Airport Land outside of Coppell City Limits) located south of LBJ (IH 635), east of Royal Lane
and being morc particularly in Exhibit "A", attached hereto and made a part hereof for all purposes.
SECTION 2. That the property shall be developed and used only in accordance with the
fClllowing development conditions as set forth herein below:
A) Written approval from the DFW Airport Board of that portion of the site as they
relate to the "Lease Area" have been obtained prior to the issuance of any pem1its
from the City of Coppel!.
B) Provision of copies of all necessary pennits and documentation from Texas
Commission on Environmental Quality or successor for anyon-site sewage or
\vastewater disposal system.
C) Written approval from the Texas Department of Transportation to allow for
drainage and utility construction \vithin its right-of-way and under the existing
overhead lines.
D) That the existing off-premise signage, including, but not limited to the billboard 15
a non-confom1ing use.
E) Written confim1ation from TXU that all uses as proposed on the site plan arc
pem1issible within their easement prior to the issuance of any building pem1its.

F) Compliance \\ith the tree ordinance requiring a tree removal permit prior to the
removal of any trces from the site.
G) Hours of operation shall not exceed 6:00 a.m. to 11 :00 p.m., 7 days a week.
SECTION 3. That the Site Plan, Landscape Plan, Floor Plan and Elevations attached to as
Exhihits "B". "C". "D" and "E". respectively, and made a part hereof for all purposes, are hereby.

SECTION 4. That the above property shall be used only in the manner and for the purpose
pro\lded for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore
amended, and as amended herein.
SECTION S. That all provlsions of the Ordinances of the City of Coppell, Texas, in
conflIct with the provisions of this ordinance be, and the same are hereby, repealed, and all other
pro\isions not in conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 6. That should any sentencc, paragraph, subdivision, clause, phrase or section
ul tIllS ordinance be adjudged or held to he unconstitutional, illegal or invalid, the same shall not
aftCct the validity of this ordinance as a whole, or any part or provision thcreof other than the pm1 so
decided to be unconstitutional, illegal or invalid. and shall not affect the validity of the
C,)mprehenslve Zoning Ordinance as a whole.
SECTION 7 An offense committed hefore the effective date of this ordinance is governed
b\ prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effect
\\ hen the offense was committed and the fonner law is continued in effeet for this purpose.

SECTION 8. That any person. fim1 or corporation violating any of the provisions or terms
oltlllS ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning
Ordinance of the City of Coppel!' as heretofore amended, and upon conviction shall be punished by
a fine not to cxcced the sum of Two Thousand Dollars (52,000.00) for each offense: and each and
e\ er) day such violation shall continuc shall he deem cd to constitute a separate offense.
SECTION 9. That this ordinancc shall take effect immediately from and after its passage
and the publication of its caption, as the law and charter in such cases provide.
