I reviewed the Landscape Plan approved by Council, and it does indicate the ornamental trees being
substituted for the over story trees (planted at a ratio of three to one) along the northern edge of the 40
foot Atmos Easement. As discussed, that entire 40' will become the landscape buffer, which will ultimately
may be shared with the property to the north, once developed for a similar use. At that time, additional
ornamental trees and shrubs may be required to fulfill the landscape requirements of the northern lot.
That being said, the entire 40' needs to be dedicated as an off-site landscape easement.

I wanted to bring to your attention a possible issue with one of the
conditions of approval for the site plan and plat for the Transwestern
Gateway Business Park No.3 project as stated in Gary's approval letters
of January 10, 2007.
Condition 1 is requiring a 10-foot strip to be dedicated for an off-site
landscape easement allowing for planting of "overstory" or "ornamental"
trees within the 10-foot landscape easement area. ATMOS will not allow
planting of overstory trees anywhere within their 40-foot easement or
understory trees within 15-feet of their gas line, and the curb line of
the site is 15-feet from the gas line. A TMOS will allow shrubs within
10-feet of their gas line.
The landscape plan submittal for the City Council approval reflected
that which ATMOS will allow; shrubs within a 5-foot area behind the curb
for screening and 3-inch caliper trees along the far north line of the
gas easement.
Can you confirm that the landscape plan submitted for approval by City
Council is acceptable. Is this an issue that the City approval letter
is stating a condition that cannot be met due to limitations stipulated
by A TMOS? I believe we are meeting the requirements that were
previously discussed with Staff and presented to Council. We want to be
sure we are all in agreement to the same conditions.
