Re: Request to Delay Required Landscape Improvements at
Atmos High Pressure Gas Easement North of TDC Gateway
Business Center Phase One-Building One
Dear Marcie,
Per our telephone conversation regarding the fact that Atmos
Energy will be installing a new high gas line through subject
easement to extract natural gas from the Barnett Shale
formation below Dallas/Ft. Worth International Airport we duly
request the following:
./ Delay the installation of landscape and irrigation
requirements depicted in our site plan submittals for Phase
One until new gas line has been installed in the easement
or Atmos re-sends their intention to perform subject work.
./ Allow Phase One Buildings One and Two to acquire permits
and certificates of occupancy on both core and shell and
any/all future interior finish-out projects once all other City
requirements have been met.
./ If subject gas line work completes after August 1st with the
understanding 30 days is reasonable timeframe for contract
negotiation, mobilization and procurement of plantings the
City will allow us to hold off on subject plantings until the
following month of April to guarantee hydro-seeding will
flourish.

../ If TDC Gateway Business Center Land, LP sells or develops
the parcel directly north of subject easement, landscape
improvements are to commence per the first three points
above.
