Cass, Sr. 213 Wilshire Drive Coppell, Texas 75019 RE: Case No.: PD-230-0 Riverchase Golf Course Dear Mr. Cass: The following are responses to your specific questions posed in your Reply Form to the above captioned rezoning request: I. Why change in zoning? Current procedures are adequate to provide alcoholic beverages to golfers. a. The owners of Riverchase Golf Course, similar to many local restaurants who provide the same customer service, in the City of Coppell, desires to change their T ABC license from a "Private Club" to a "Mixed Beverage" permit. However, both state and local laws prohibit the selling of beer in "residential areas or residential zoning districts". The existing golf club property is zoned Single Family-12 with a Special Use Permit for a Golf Course. So, to establish a non- residential zoning while preserving the existing development, a Planned Development - Office (PD-O) District for Golf Course and Ancillary Uses, was requested. 2. Why rezone the entire golf course? Why not just the clubhouse? Don't say it can't be done.... a. The owners/operators of Riverchase Golf Course desire to continue to allow the beverage cart on the golf cart path, so the non-residential zoning needed to incorporate the cart path also. 3. Why not a simple change in State Law to permit sale of alcoholic beverages at golf clubhouses, regardless of zoning, if not prohibited by local laws. a. An amendment to the State of Texas Local Government Code is not under the purview of municipal government. If the Legislature were to consider change State Law, it would have to wait until the next session, which is two years off. 2 5 5 PAR K WAY * P.O. This Planned Development-230-0 for Golf Course and Ancillary Uses, will include conditions as well as exhibits which will tie the Planned Development District to what currently exists on the ground, specifically: o Exhibit "B" will be the Detail Site Plan of the club house, maintenance building, golf cart storage building and parking area. o Exhibit "c" will be the Golf Course Site Plan, which is actually an aerial view of the existing golf course development. With these exhibits attached to the Ordinance, no additional development may occur with this golf course without an amendment to the PD (rezoning) through a public hearing process. For reference I have also included the staff report which elaborates on other issues addressed in this case. I apologize for not responding earlier, but we received approximately 100 written responses to this rezoning request, and at least that many phone inquiries that has kept me from preparing individual responses.
