T FIRE SERVICE WATER AGREEMENT THIS FIRE SERVICE WATER AGREEMENT is entered into by and between KTR Coppell LLC, a Delaware limited liability company, owner of Lots lR, 2R, 3R and 4R, Block 1 of the Minyard Addition, an addition to the City of Coppell, Dallas County, Texas, according to the plat herewith recorded in the Map Records, Dallas County, Texas, (hereinafter referred to separately as Lot lR, Lot 2R, Lot 3R and Lot 4R and together as the "Lots") and evidences the following WHEREAS, the Lots have been designed and constructed to operate as a unified warehouse/office development, and WHEREAS, all four lots benefit from having a comprehensive fire service water plan to serve the four lots together WHEREAS, the fire water service plan prepared by Jones & Carter, Inc., dated August 1, 2007 (the "Utility Plan" ) shows that the fire service water main runs from and between the Lots as shown on the Utility Plan attached hereto and incorporated herein as Exhibit A, NOW, THEREFORE, for and in consideration of the above and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties do hereby agree as follows 1. The recitals set forth above are incorporated as if fully set forth herein. 2. Each Lot owner, its successors and assigns, hereby authorizes and does hereby give its permission, in perpetuit, to the other Lot owners, their successors and assigns to allow said fire service water main to enter into and cross its Lot. 3. Each lot owner agrees maintain its Lot and its portion of said fire service water main so as to continuously provide fire flows to the other Lots. 4. Each lot owner agrees that it will not significantly reduce or negatively impact the flow capacity or operation of said fire service water main as shown in Exhibit A without first obtaining written permission from the affected Lot owners. 5. This Agreement is a covenant running with the land and it is binding on the heirs, successors and assigns of the parties hereto. . T SHARED ACCESS AGREEMENT THIS SHARED ACCESS AGREEMENT is entered into by and between KTR Coppell LLC, a Delaware limited liability company, owner of Lots IR, 2R, 3R and 4R, Block 1 of the Minyard Addition, an addition to the City of Coppell, Dallas County, Texas, according to the plat herewith recorded in the Map Records, Dallas County, Texas, (heremafter referred to separately as Lot lR, Lot 2R, Lot 3R and Lot 4R and together as the "Lots") and evidences the following WHEREAS, the Lots have been designed and constructed to operate as a unified warehouse/office development, and WHEREAS, all four lots benefit from having a comprehensive access plan to serve the four lots together WHEREAS, the site plan prepared by Jones & Carter, Inc., dated August 1,2007 (the "Site Plan" ) shows that fire lanes and access drives run from and between the Lots as shO\vn on the Site Plan attached hereto and incorporated herein as Exhibit A, NOW, THEREFORE, for and in consideration of the above and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties do hereby agree as follows 1. Each Lot owner, its successors and assigns, hereby authorizes and does hereby give its permission, in perpetuit, to the other Lot owners, their successors and assigns to have rights of ingress and egress by way of driveways over and across its Lot as shown in Exhibit A. 3. Each lot owner agrees to maintain its Lot so as to continually provide access to the other adjacent Lots. 4. Each lot owner agrees that it will not significantly reduce or otherwise limit access to adjacent Lots as shown on Exhibit A without first obtaining written permission from the affected Lot owners. 5. This Agreement is a covenant running with the land and it is binding on the heirs, successors and assigns of the parties hereto. Dallas County, Texas, (hereinafter referred to separately as Lot 1 R, Lot 3R and Lot 4R and together as the "Lots") and evidences the following WHEREAS, the Lots have been designed and constructed to operate as a unified warehouse/office development, and WHEREAS, all three lots benefit from having a comprehensive sanital)' sewer plan to serve the three lots together WHEREAS, the sanital)' sewer plan prepared by Jones & Carter, Inc., dated August 1,2007 (the "Utility Plan" ) shows that sanitary sewer mains and service lines run from and between the Lots as shown on the Utility Plan attached hereto and incorporated herein as Exhibit A, NOW, THEREFORE, for and in consideration of the above and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties do hereby agree as follows 1. Each lot owner agrees that it will not significantly reduce or negatively impact the capacity of the sanitary sewer main as shown in Exhibit A without first obtaining written permission from the affected Lot owners. 5. This Agreement is a covenant running with the land and it is binding on the heirs, successors and assigns of the parties hereto. STORMW A TER DRAINAGE AGREEMENT THIS STORMW A TER DRAINAGE AGREEMENT is entered into by and between KTR Coppell LLC, a Delaware limited liability company, owner of Lots lR, 2R, 3R and 4R, Block 1 of the Minyard Addition, an addition to the City of Coppell, Dallas County, Texas, according to the plat herewith recorded in the Map Records, Dallas County, Texas, (hereinafter referred to separately as Lot 1 R, Lot 2R, Lot 3R and Lot 4R and together as the "Lots") and evidences the following WHEREAS, the Lots have been designed and constructed to operate as a unified warehouse/office development, and WHEREAS, all four lots benefit from having a comprehensive drainage plan to serve the four lots together WHEREAS, the drainage plan prepared by Jones & Carter, Inc., dated August 1, 2007 (the "Drainage Plan" ) shows that stormwater runoff drains from and between the Lots as shown on the Drainage Plan attached hereto and incorporated herein as Exhibit A, NOW, THEREFORE, for and in consideration of the above and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties do hereby agree as follows 1. The recitals set forth above are incorporated as if fully set forth herein. 2. Each Lot owner, its successors and assigns, hereby authorizes and does hereby give its permission, in perpetuit, to the other Lot owners, their successors and assigns to discharge stormwater over and across its Lot. 3. Each lot owner agrees maintain its Lot so as to accept the stormwater runoff that flows from the other Lots. 4. Each lot owner agrees that it will not significantly increase the stormwater runoff as determined in the Drainage Plan and shown in Exhibit A without first obtaining written permission from the affected Lot owners. 5. This Agreement is a covenant running with the land and it is binding on the heirs, successors and assigns of the parties hereto. . T
