Kegs 'N Cellar signage
Jim: Here's a brief history of the Kegs 'N Cellar zoning case and a possible solution to Mr. Pratt's signage dilemma:
The code amendment defining regulations for beer/wine and neon signs was approved by Council on December 12, 2006.
Kegs 'N Cellar Special Use Permit was approved in March 2007, allowing a total of 46 square feet of signs. Incidentally,
when the zoning was granted, the applicant was not Mr. Pratt. There are presently two signs on the building, each 23
square feet in size, so total signage square footage allowed by the SUP can not be increased. It appears to me that the
present owner has two options: 1. reduce the size of the eXisting signage to a point where one additional sign could be
constructed, still not exceeding the 46 feet allowed by ordinance--not too practical. 2. Amend the SUP to allow additional
signs. Based upon the Building Official's interpretation of the sign ordinance, additional signage can be allowed on this
building if the SUP is amended.
Some additional history: An illegal sign was attached to the west end of the building some time ago without benefit of
obtaining a sign permit. That sign has been removed at our insistence. The present owner was advised that neon was not
allowed and verbally agreed to turn the neon off. He did not follow through with that agreement and the Building Official
sent him an official request to remove the neon. As an aside, this individual threatened staff to "take his request to a higher
level" if we would not allow his additional signage.
Bottom line: Additional signage can be allowed through an amendment to the SUP. Neon and "beer and wine" advertising
is not allowed.
