WHEREAS, the City Plannin~; and Zoning Commission and the governing body of the City of Coppell, Texas, in compliance with the laws of the State of Texas and pursuant to the Comprehensive Zoning Ordinance of the City of Coppell, have given r-equisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, and to all persons interested and situated in the affected area and in thc vicinity thereof, the said goveming body is of the opinion that Zoning Application No. PD-2l 7R-C should be approved, and in the exercise of legislative discretion ha~~e concluded that the Comprehensive Zoning Ordinance and Map should be amended. NO~~', THF,REFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITS' OF COPPELL, TEXAS: SECTIOI~ 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppci.l, Texas, duly passed by the go~-erning body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended by granting a change in zoning from C(Commercial) and PD- 217-C (Planned Development-217-Commercial) to PD-217R-C (Planned Development-217 Revised-Commercial) to expand the detail site plan to allow an increase in the out-of-doors pet ~rtit =~,of,<i? ~~uo care exercise area on 1.01 acres of property located at 120 E. Bethel School Road, and being more particularly described in Exhibit "A", attached hereto and made a part hereof for all purposes. SECTION 2. This Planned Development shall be developed and used only in accordance with the Site Plan and Landscape Plan with Elevations of the Screening Walls, and the development standards as follows: (A) The Planned Develapment shall comply with the use regulations set forth in Zoning Ordinance Number 95100-A-461, except as amended herein. (B) In lieu of the required 10-foot wide landscape buffer area, a 10-foot wide off- site landscape easement shall be permitted along the northwest property line. (C) The animals shall be only allowed in the out-of-doors pet care exercise area, Monday - Friday from 7:30 a.m. to 8:30 p.m. and Saturday - Sunday from 9:00 a.m. to 8:30 p.m. SECTION 3. The property shall be developed and used in accordance with the C (Commercial) development standards under the Coppell Zoning Ordinance, except as amended in the special conditions as indicated on the Site Plan, Landscape Plan with Elevations of Screening Walls attached hereto as Exhibits `B and C", respectively, and made a part hereof for all purposes, which are hereby approved. SECTION 4. That the above property shall be used only in the manner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended and as amended herein. SECTION 5. That all provisions of the Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. 2 TM 36069 2.OOU SECTION 6. That should any sentence, paragraph, subdivision, clause, phl-ase or section of (his ordinance be adjud~ed or held to be unconstitutional, illegal or im~alid, the same shall n~t affect the validity of this ordinance as a~-hole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the ~•alidity of the Comprehensive Zoning Ordinance as a whole. SECTION 7. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effcct when the offense was committed and the forn7er law is continued in effect for this purpose. SECTION 8. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the sarlle penalty as provided far in the Cornprehensive 7_.onin~~ Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offensc; and each and every day such violation shall continue shall be deeined to constitute a separate offense. SECTION 9. 1'hat tllis ordinance shall take effect immediately from a~1d after its passabc and the publication of its caption, as the law and charter in such cases provide.
