We have been instructed by our client, The Catholic Diocese of Dallas, to not show the dedication of land nor the construction of the eastern portion of Samuel Blvd. I understand that a mutual agreement will be forthcoming. However, at present, it is in the hands of their legal counsel. Taryon, I have also enclosed 5 (five) copies of the landscape plan that is part of this submittal. Under zoning ordinance, section 29, our project will require a Specific Use Permit. The exterior finish material we propose to use is a stucco type material, manufactured by Thoro Systems Product, Inc., and used extensively in our area. I met with Mr. Dale Jackson to review the product and he takes no exception to its use. The design concept for our church will have a Spanish or Mexican influence, and the material should be compatible to this style of architecture. We therefore request in our S.U.P., that provisions be made to permit the use of this material. It is our understanding that the Postal Center will have the same material for their exterior finish. ~/~ Y~'Ot to Marini~ OM/jm cc: Mr. Dale Jackson Building Inspection AN ORDIMAMCK OF THPt CITY OF COFpKI_I_; TKXAS AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, TO ADD A NEW SECTION 29.14 TO THE SPECIAL USE SECTION OF THE ZONING ORDINANCE ESTABLISHING SPECIAL USE REGULATIONS FOR CHURCHES; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. ~illtlaEA~, the City Zoning Commission and the Governing Bod~ of the City of Copt)ell, Texas, in compliance with the laws of the State of Texas with reference to amending the Zoning Ordinance, have given requisite notices by Dublieation and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Bod~ is of the opinion that Ordinance No. 297, the Comprehensive Zoning Ordinance of the Cit~ of Coppelt, should be amended in the exercise of its legislative discretion; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That Section Z9 of the Comprehensive Zoning Ordinanee of the City (Ordinance No. 29?), which establishes the use regulations for the special use classification, be, and the same is hereby, amended by addinl[ a new Section ~-9.14 which shall read as follows: °29.14 AMY D~TRIICT 1. Churches A church may not be excluded from any zoning district within the City, therefore the Special Use Permit required by this ordinanee may not be denied. In the isstmnee of such Special Use Permit, there shall be imposed only those reasonable special conditions or regulfttJons necessary to protect the health, safety, and general welfare of the eommunity. Offstreet parking shall be regulated by Section 30.6(4) of this oFdinanee. A site plan my be required as a part of the applieation for this Special Use Permit and unless modified by approval of a site plan adopted as a part of the ordinanee granting the Special Use Permit, set back and other such requirements shall be governed by the regulations of the basic zoning distriet, and the structural requirements shall be governed by the existing ordinances of the City. All ohm'abes in existence at the time of the adoption of this amendment shall be considered as conforming uses under Special Use Permit in regard to all eh~eh facilities in place as of the effective date of this amendment. Once a ehtweh has received a special use permit it will not have to obtain another special use permit to expand church facilities within the church property. Church use shall be permitted in any Commereial Zoning District without a special use permit." SECTION 2. That the use of the term "Chm'ehes" shall be deleted in its entirety from Sections 29.5(4) and 29.6(3) of said ordinance. SECTION 3. That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of*this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions at' terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to amend the Zoning Ordinance of the City in order to permit proper development and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after its passage and publication of its caption, as the law in such eases provides.
