COPPELL SWITCHING STATION A 3.407 acre site located on the northwest corner of Thweatt Road and Coppell Road CHRONOLOGICAL REPORT SPECIAL USE PERMIT APPLICATION. T U Electric represented by Mark Carpenter, submitted Special Use Permit and preliminary plat applications on February 14, 1989 for a for the operation of an 138 KV electric substation, along with landscape and site plans for review. PLANNING AND ZONING COMMISSION ACTION Four variances were requested by the applicant and are listed as follows: 1) Using rock versus concrete for yard surface 2) Open ditch drainage 3) Minimum landscaping to be done at the time (Complete landscaping to be done when street is widened) 4) Rock instead of concrete drive (Concrete to be added when street widened) CITY COUNCIL ACTION April 11, 1989 (See Exhibit A, B & C) Council approved the Special Use request with the stipulation that the applicant work with staff to provide landscaping comparable to that of the Haekberry substation. DRAFT AGREEMENTS Staff had assembled a street escrow agreement for the City and TU Electric to agree upon. At this time, TU Electric did not want to participate in donating the r.o.w and also paying their pro-rata share, so they set up a meeting with Alan Ratliff to pursue a compromise. ORDINANCE APPROVAL August 14, 1990 An ordinance was approved for Case #S-1041, to change the zoning from LI to LI-SUP, for the operation of an electric substation. (Ord. #297-A-84) COPPELL SWITCHING STATION, FINAL PLAT APPLICATION T U Electric represented by Roy Turner, submitted applications on April 7, 1989 for a Final Plat, to allow to operation of an 138 KV electric substation, in order to obtain building permits. PLANNING AND ZONING COMMISSION ACTION April 20, 1989 Initially, when this final plat was reviewed, staff had requested that the following items be agreed to prior to approval of the final plat: Four 1) Separate dedication instruments for future road easements to be executed and filed with the City prior to proceeding to Council. 2) Items per the City Council on April 11, 1989, (Preliminary Plat). 3) Applicant agree to enter into escrow agreement with the City of Coppell for their pro-rata share of improvements to Thweatt and Coppell Roads. (Total due: $140,204.00). 4) Add note to the plat that after adjacent roads are improved, within 30 days thereafter, applicant shall install landscape as required per the Streetscape Plan. variances were requested by the applicant as follows: 1) Using rock versus concrete for yard surface 2) Open ditch drainage 3) Minimum landscaping to be done at that time (Complete landscaping to be done when street is widened) 4) Rock instead of concrete drive (Concrete to be added when street widened) Staff recommended the escrow agreement be executed and that separate dedication easements for right-of-way be executed and filed before final plat approval. The Planning Commission recommended approval of the final plat and variances with the exception of variance//3 which was changed to read: provide full landscaping on the Coppell Road and Thweatt Road sides, extending 20 feet past the present fence on both the north and the west." "To CITY COUNCIL ACTION Tom Parsons, of TU Electric had indicated a desire to have additional discussions on this item prior to council action and that it be reconsidered. On May 9, 1989, the City Council denied this plat without prejudice, waiving all fees for the plat to be re-considered at a future date. Mr. Ratliff met with Mr. Parsons to come to an agreement on the roadway and easement issues. According to a letter addressed to the City Council (See Exhibit B) a consensus was reached between the two. Mr. Ratliff prepared a confidential memorandum to the Council informing them of the agreement reached between Mr. Parsons and himself. Final plat was re-considered by the City Council on June 13, 1989. Attached to the request was a letter from the City Manager to the City Council indicating an agreement had been established between Tom Parsons and Alan Ratliff. In summary, TU Electric would donate the right-of-way for Coppell and Thweatt Roads at the site and the Old Brazos Light right-of way along Sandy Lake Road, as well the cost of relocating the line within our right-of-way when Sandy Lake is improved. In return, the City would agree not to assess TU Electric for the street paving costs, which would result in significant cost savings to the City in future right-of-way acquisition and utility power line relocations. Additionally, the City Manager requested that TU Electric provide executed easements for the right-of-way for Coppell and Thweatt Roads. The City Manager recommended that a motion be made to approve the plat along with the aforesaid condition. After discussion, the motion was made to approve the final plat with the variances as listed on the plat, with the further provision that TU will be relieved of the cost of paving, contingent upon TU's dedication of right-of-way for both Coppell and Sandy Lake Roads and donate the right-of-way for the old Brazos Power and Light easement which parallels Sandy Lake Road. S-1041(A) Special Use Permit Amendment APPLICATION Brazos Electric Utilities, represented by Albin Petter, submitted a Special Use Permit application on December 23, 1992 for a Special Use Permit for the expansion of the operation of an 138 KV electric substation, along with landscape and site plans, a historical report (See Exhibit D). DEVELOPMENT REVIEW COMMITTEE Members of the DRC discussed at both meetings, the possibility of assessing the street pro-rata for the front footage along the subject property, since it had not been collected within the final plat stage several years earlier. In order to allow the case to proceed forward, staff continued working with the applicant on an agreement between the City and TU Electric. PLANNING AND ZONING COMMISSION ACTION While reviewing the plat files, staff found information indicating an agreement was to take place between the city and TU Electric. When staff presented its findings to the applicant, Mr. Petter stated he had no problem removing the poles along Sandy Lake Road and that the easements along their frontage of Sandy Lake and Coppell Roads had already been dedicated to the City. Staff still felt uncomfortable that such an agreement had not yet been formalized and executed, and felt it was time to put one together. When staff discussed the agreement with the applicant, Mr. Petter still had no problem with the agreement until we asked for an exhibit which specifically indicated the location of each pole and its proximity within the right-of-way along Sandy Lake Rd. It was at this time that staff determined that the agreement (See Exhibit Cs-) was not ready to be discussed at the Council meeting. CITY COUNCIL ACTION February 9, 1993 City Council denied the request for an amendment to the site plan. Report prepared by Taryon Bowman, P&Z Coordinator February 24, 1993 CITY MANAGER'S COMMENTS/RECOMMENDATION FOR AGENDA ITEM ITEM # ~ CITY COUNCIL AGENDA DATED 4-11-89 We have recently learned that there may have been a change in the ownership of the Brazos Power & Light Utility easement which parallels Sandy Lake Road and it is now owned by Texas Utilities. One of the long-term considerations facing this city is that if we ever plan to widen Sandy Lake Road, it would be necessary to secure the right-of-way within this easement. I have been told that the easement was originally acquired by Brazos Power & Light and is considered a "private easement" which means that the City would have to purchase this right-of-way when we widen Sandy Lake Road. It has been reported that the City of Carrollton paid a significant amount for a similar easement. In Coppell it cost approximately $4,000 to move one (1) utility pole in this easement during the development of the McDonald's business. We have also been reminded by Mr. Tom Parsons that the TU franchise agreement expires in 1992 and that they would have preferred to have worked this out long before now. It may be appropriate to begin to position ourselves to negotiate for the Sandy Lake easement which we may need from Texas Utilities. and/or other items In this $.U.P. case TU has indicated that they plan to do some landscaping around the site, but desire to be released from the streetscape requirements until the adjacent roads are improved to their full capacity. I would recommend that you consider requiring TU to put birms and significant landscaping improvement around this site since it is adjacent to a residential subdivision and one of our future major thoroughfares. An e:~mple of the type landscaping can be seen south of Coppell on Beltline Road between 114 and 635. At that location there is a switching station which appears to be well landscaped. TU should provide similar landscaping for this switching station in Coppell. since the S.U.P. has been published, Council could open the item and then table it to a future meeting to allow staff to have additional time to gather more information about these various issues. TU will probably press you to approve this S.U.P., but time should be in our favor. MEMORANDUM May - © 1 9S9 TO: FROM: SUBJECT: Mayor and City Council Alan D. Ratliff, City Manager ~\ Meeting 5-17-89 ADR/Larry Jackson/Tom Parsons and Other TU Representatives REF: TU Final Plat Mr. Tom Parsons, District Manager, TU Electric, expressed his concern with having to pay street assessment for the widening of Coppell and Thweatt Roads when they were donating/providing the right-of-way for the widening of the two roads. Mr. Parsons expressed the viewpoint that as a franchisee of the city, they should be given consideration for this relationship and should not have to donate/provide right-of-way and also pay street assessments. I have attempted to find some basis by which we could come to agreement in this matter and suggested to Mr. Parsons that if TU would: 1) pay the costs for relocating utilities along Sandy Lake Road (the old Brazos Power & Light private right-of-way), and 2) donate right-of-way to the City, then in all likelihood, you would find this an acceptable trade for the paving costs. Mr. Parsons indicated he felt this would be acceptable to TU. I have been concerned for some time that when the city attempts to widen and pave Sandy Lake Road we would have to pay for this privately acquired right-of-way. This proposed trade appears to be favorable to the city of Coppell and could save the city this possible expense. We recommend that you attempt to secure and approve this arrangement at the time you approve TU's final plat on June 13th. Please let me know if you have any questions or comments on this agreement. Texas 76702-2585 (8171 750-6501) FAX (817) 750-6290 December 23, 1992 TO THE CITY OF COPPELL CITY COUNCIL AND PLANNING & ZONING COMMISSION In 1941 and 42 Brazos Electric Power Cooperative, Inc. constructed a 69 KV transmission line along Thweatt Road through what is now the city of Coppell. Brazos Electric and TU Electric jointly reconstructed this line as a 138 KV double circuit single steel pole transmission line in 1986. In 1942, Brazos Electric purchased the Coppell Substation site, a 2.0 acre site, at the intersection of Thweatt Road and Coppell Road, under the existing transmission line. In 1944, easements for a transmission line were purchased; and this transmission line was constructed in 1948, parallel to and approximately 100 feet west of Coppell Road from the Coppell Substation site, in a northward direction. At this same time, the towers, poles, s~vitches, insulators, control house and other electrical equipment was placed in sera'ice at the Coppell substation site. In 1984 and 85 Brazos Electric and TU Electric jointly reconstructed the transmission line along Thweatt Road and converted it to 138 KV operation. Also, at the same time Brazos Electric reconstructed the line from the Coppell substation in a northward direction and converted it to 138 KV. All of the towers, switches, etc., was removed at this time, with the exception of the control house which was removed in 1989. During the conversion of the transmission lines from 69 KV to a 138 KV, TU Electric purchased an additional 1.4376 acre tract of land adjacent to Brazos Electric's Coppell substation site. TU purchased the land to interconnect the Brazos Electric and TU electrical system, which would benefit both utilities. TU & Brazos Electric, at that time, obtained a Special Use Permit from the City of Coppell for an electrical substation at this site. TU constructed a distribution substation at the Coppell substation in 1989-90 through which TU serves the citizens of Coppell and some adjoining cities with the power from this substation. Brazos Electric now wishes to complete the interconnection between Brazos Electric and TU at the Coppell substation. This interconnection allows for an exchange of electrical power between the two utilities. If one of the utilities loses a transmission line or chooses to take it out of service, the substation can continue serving the customers ~vith the power from the other line. Presently the Brazos Electric lines along Thweatt Road and Coppell Road merely pass through the substation without interconnecting. Brazos Electric proposes to construct three 48 foot 6 inch towers inside the substation. These towers will be 13 feet shorter than the existing tower in the substation. The existing screening fence and landscaping will be extended 90 feet along Thweatt Road and 90 feet along Coppell Road. Approximately 235 feet of screening fence exists along Thweatt Road and 215 feet of screening fence exists along Coppell Road. The new fencing will match the old fence. With this construction at the Coppell substation, Brazos Eleetric's taxable investment within the City of Coppell will be considerably increased. Griffin, P.E., City Engineer Coppeil Switching Station SUP for Amendment to the Site Plan January 15, 1993 I spoke with Mr. A1 Petter with Brazos Electric in Waco on January 15, 1993, concerning the right-of-way dedications and escrows for this project. As you are well aware, there was an agreement reached at the June 13, 1989, City Council meeting concerning the waiver of escrow to be paid on this project. In return for the waiver, Brazos Electric and/or TU Electric agreed to dedicate the fight-of-way for Coppell Road, Sandy Lake Road, the old Brazos Light fight-of- way along Sandy Lake Road, and bear the cost of any relocation of their lines within that right- of-way when Sandy Lake is improved. Mr. Petter stated that it was their understanding that the dedication of the old Brazos Light right- of-way along Sandy Lake would not take place until the Sandy Lake project was initiated by the City. That project could take anywhere from five or more years to be initiated by the City. I informed Mr. Petter that I was concerned that because of the tremendous time lag from the agreement in 1989 to the future initiation of the project' there could be some communication problems in the dedication of that Brazos Light line as right-of-way. I told Mr. Petter that I would contact you to see if we could require that a note be placed on the face of the plat that references the June 13, 1989 City Council meeting and the fact that the right-of-way along Sandy Lake Road will be dedicated to the City and the power lines will be relocated at no cost to the City when the Sandy Lake project is initiated.
