That MLRP PARK WEST LAND LLC, a Delaware limited liability company, acting herein by and through
its duly authorized officers, does hereby adopt this replat designating the herein above described
property as PARK WEST CROSSING, LOTS 2, 3, 4 & 5, BLOCK A, an addition to the City of Coppell,
Dallas County, Texas, and does hereby dedicate, in fee simple to the public use forever, the
streets enc: alleys shown thereon.
The streets and alleys are dedicated for street purposes. The easements and public use
areas, as shown, are dedicated for the public use forever for the purposes indicated on this
replat. No buildings, fences, trees, shrubs or other improvements or growths shall be constructed
or placed upon, over or across the easements as shown, except pavement, parking lots, and that
landscape improvements may be placed in landscape easements, or as specified by planned development,
if approved by the City of Coppell. In addition, utility easements may also be used for the mutual use
and accommodation of all public utilities desiring to use or using the some unless the easement
limits the use to particular utilities, said use by public utilities teeing subordinate to the
public's and City of Coppell's use thereof. The City of Coppell and public utility entities
shall have the right to remove and keep removed all or parts of any buildings, fences, trees,
shrubs or other improvements or growths, which may in any way endanger or interfere with the
construction, maintenance, or efficiency of their respective systems in said easements.
The City of Coppell and public utility entities shall at all times have the full right of
ingress and egress to or from their respective easements for the purpose of constructing,
reconstructing, inspecting, patrolling, maintaining, reading meters, and adding to or
removing all or parts of their respective systems without the necessity at any time of
procuring permission from anyone.
That the undersigned do hereby covenant and agree that they shollconstruct upon the fire
lane easements, os dedicated and shown hereon, a hard surface and that they shall
maintain the same in a state of good repair at all times and keep the some free and clear
of any structures, fences, trees, shrubs, or other improvements or obstruction including,
but not limited to, the parking of motor vehicles, trailers, boats or other impediments to
the access of fire apparatus. The maintenance of paving on the fire Ione easements is the
responsibility of the owner, and the owner shall post and maintain appropriate signs in
conspicuous places along such fire lanes stating 'Fire Lane, No Parking". The police or
his duly authorized representative is hereby authorized to cause such fire lanes and utility
easements to be maintained free and unobstructed at all times for fire department and
emergency use.
The undersigned do covenant and agree that public access easements may be utilized by
any person or the general public for ingress and egress to other real property, and for the
purpose of general public vehicular and pedestrian use and access, and for fire
department and emergency use in, along, upon and across said premises with the right
and privilege at all times of the City of Coppell, its agents, employees, workmen and
representatives having ingress, egress and regress in, along, upon and across said
premises.
DECLARATION OF
PRIVATE WATER LINE EASEMENT
MLRP PARK WEST LAND, LLC, a Delaware limited liability company ("Declarant') hereby declares the
Property shall be held, sold, used and conveyed subject to the following private water line easement
and covenants, which -shall run with the title of the Property:
1.The Property is hereby made subject to a private water line easement (the "Easement') as shown
hereon.
2.The Easement shall be for the purposes of providing fire flow to ail lots on the Property as
shown and shall include the rights to excavate the land within the Easement to install pipes, valves,
fittings, and hydrants, and to keep, maintain, repair, and replace all improvements so constructed.
3.After Declarant shall have constructed within the Easement the water line used for fire flow
purposes, such water line shall not be materially altered without the consent of the owners of ail
of the Property benefited by the Easement; provided however, that consent shall not be unreasonably
withheld or delayed if alteration is reasonably necessary to accomplish proper fire flow requirements.
Each owner of any portion of the Property shall maintain the water facilities within the portion of
the Easement located on such owner's portion of the Property in a state of good repair so that
the water line shall function as intended.
4.If an owner fails to maintain the water facilities located within the Easement on such owner's portion
of the Property, any other owner may enforce such obligation by any lawful means, and shall have the
right of ingress and egress to or from and upon the Easement for the purpose of inspecting, maintain,
reconstructing and adding to or removing all or parts of its water facilities, and the right to remove
and keep removed all or parts of any building, fences, shrubs, trees, or other improvements or growths
which, in any way, endanger or interfere with the construction, maintenance or efficiency of its use of
the Easement.
5.This Declaration shall be binding upon all parties having any right, title or interest in any portion of
the Property, their heirs, successors, and assigns, and shall inure to the benefit of Declarant and each
owner of any portion of the Property.
This replat approved subject to all replotting ordinances, rules, regulations and resolutions of
the City of Coppell, Texas.
