Staff was not aware this facility had a pre-existing kitchen and
the applicant did not advise them of this fact. At the time of
the original application, the applicant did not indicate they
intended to prepare food on site. Staff thought food to be sold
would be all pre-packaged as is generally sold in "quick marts".

intersection. (Lot 7 of the Coppell Heights Addition).

SUMMARY: Applicant was unaware that the present zoning
(C-SUP) did not allow operation of a restaurant;
therefore, applicant requests that the new proposed
SUP provide this.

Dear Mr. Doyle:
This letter is in response to our telephone conversation
on January 17, 1989, and conversations with Mr. Dale Jackson,
Chief Building Official, and Mr. Larry Jackson, City
Attorney, on January 18, 1989. It is my understanding from
the above referenced conversations, that we are required to
submit for a revision to the above referenced Special Use
Permit, allowing the use of the existing kitchen equipment.
It is my further understanding from Mr. Dale Jackson, that
the existing building should be classified as a restaurant,
due to the existing kitchen equipment's capacity.
As I have mentioned in previous correspondence, I feel that
my client has made a diligent effort to meet the standards
set by the City of Coppell, within the constraints the
current ordinance has added to this site. We have also worked
with the staff of the City in addressing issues mentioned by
the Planning and Zoning Commission. We have tried to provide
a cost effective retrofit of the existing facilities for the
Owner's use, as well as providing an attractive addition to
the City of Coppell.
I hope you will agree to our request for a revision to SUP
Case # S-1038, to use the existing kitchen equipment and
tables. If there is anything we can provide in addition to
the enclosed information to clarify this matter, please do
not hesitate to let me know.

This letter is to inform you that your request for application of a
Special Use Permit was approved with variances by the City
Council of the City of Coppell on December 13, 1988 with the
condition that the canopy and surface around the building conform to
some type of masonary type substance, and that any gasoline tanks
adhered to the latest EPA and Texas Water Commission rules and
regulations.
Please submit your building plans to the Building Inspections
Department for review and approval in order to receive a building
permit.

Minutes of March li, 1989
The City Council of the City of Coppell met in regular called session on
Tuesday, March 14, 1989, at 7:30 p.m. in the Coppell Town Center, 255 Parkway
Boulevard, Coppell, Texas,
The following members were present:
Lou Duggan, Mayor
Dean Wilkerson, Mayor Pro Tem (late arrival)
Walter PettiJohn, Councilman
Tom Morton, Councilman
Bill Smothermon, Councilman (late arrival)
Jim Cowman, Councilman
Mark Wolfe, Councilman
John A. Nelson, Councilman
Also present were City Manager, Alan D. Ratliff, City Attorney Larry Jackson,
and City Secretary Dorothy Ttmmons.
Mayor Duggan called the meeting to order and asked everyone to stand while
Councilman Cowman gave the invocation. Following invocation, Mayor Duggan led
those present in the Pledge of Allegiance.
Item 3: Approval of Minutes - February 28, 1989
Councilman Morton moved that the minutes of February 28, 1989, be approved as
submitted. Councilman Cowman seconded the motion; motion carried 5-0 with
Councilmen PettiJobn, Morton, Cowman, Wolfe and Nelson voting in favor of the
motion.
Mayor Pro Tem Wilkerson arrived at this time.
Item 4: }~yor's Report
A. Mayor Duggan informed the Council that he will be taking the
students-at-large, selected during the "Students-in-Government"
programs, to Austin on Wednesday, March 15th. Accompanying him will
be two (2) teachers from the Coppell schools as well as the three (3)
student representatives, one (1) from each Elementary School in the
City. They will be spending the day in Austin with Representative Ken
Marchant and the students will serve as honorary pages sworn in by the
Sergeant-At-Arms.
B. Council was reminded of the joint work session to be held on Tuesday,
March 21, 1989, at 7:30 p.m. with the Economic Development Board.
C. Mayor Pro Tem Wilkerson presented a plaque to City Manager Alan D.
P. atliff. This plaque was presented to the City Council at the recent
Irving Chamber of Commerce meeting and recognizes Coppell as being a
regional cooperation City.
D. Councilman Cowman issued his thanks to the City for the signalization
that had been installed at Sandy Lake Road and MacArthur.
E. Councilman Cowman informed the Council that the City of Irving will be
coming before the Coppell City Council in the near future to request
signalization at the entrance to North Lake Park, The City of Irving
is leasing North Lake Park from the City of Dallas.

Item 13: Holding of a PUBLIC HEARING to consider approval of a zoning change,
Case ~ZC-518 from (R) Retail to (SF-7) Single Family-7 for single
family development at the southwest corner of Coppell Road and Sandy
Lake Road.
Date of P&Z Meeting: February 16, 1989
Decision of P&Z Commission: Approved (6-0) for
SF-7 zoning.
Mr. Nathan Maier, representing the applicant was present to discuss this item
with the Council. He stated that this item is being brought forward as a
stipulation by the Planning and Zoning Commission for approval of the property
indicated in Item No. 11 cf this agenda. Mayor Duggan declared the public
hearing open and asked for those persons who wished to speak against the
proposed zoning change. There were none. Mayor Duggan then asked for those
persons who speak in favor of the proposed zoning change. Those persons
speaking were Dr. Melvin Gross. The public hearing was then declared closed.
Following discussion on this item Councilman Morton moved that the zoning change
request be approved to SF-12. Councilman Cowman seconded the motion; motion
carried 7-0 with Mayor Pro Tem Wilkerson, Councilmen Pettijohn, Morton,
Smothermon, Cowman, Wolfe, and Nelson voting in favor of the motion.
Item 14: Holding of a PUBLIC HEARING to consider approval of a zoning change,
Case ~S-1038 at 928 Beltline Road and also to consider and approve the
waiving of filing fees. The present zoning is for a special use

City Manager Alan D. Ratliff spoke on this item. He indicated that at the time
of the original SLY zoning staff was not aware that the facility had a
pre-existing condition and that applicant had intended to prepare food on site.
In order to not create a hardship on the applicant, it is the recommendation of
the Council that additional fees for this SUP be waived as a part of the
request. Mr. Ali Bumgardner and Mr. Bill Sladovnik were also present to discuss
this item with the Council. Mayor Duggan then declared the public hearing open
and asked for those persons who wished to speak against the proposed zoning
change. There were none. Mayor Duggan then asked for those persons who wished
to speak in favor of the proposed zoning change. Again, there were none. The
public hearing was declared closed. Following discussion by the Council,
Councilman Wolfe moved that the zoning change be approved as requested with the
condition that no drive-up window be installed and that the fees to the
applicant for the zoning request be waived. Councilman Cowman seconded the
motion; motion carried 7-0 with Mayor Pro Tem Wilkerson, Councilmen PettiJohn,
Morton, Smothermon, Cowman, Wolfe, and Nelson voting in favor of the motion.
Item 15A: Discussion and consideration of approval and adoption of amendment to
the Subdivision Ordinance of the City of Coppell, Section XVI, "Fees",
on Floodplain Development Fees and authorizing the Mayor to sign.
City Engineer Russell Doyle made the presentation to the Council on this item.
He indicated to the Council that this is a pass through charge which will be
