KNOW ALL MEN BY THESE PRESENTS THAT:
COUNTY OF DALLAS
THIS AGREEMENT TO ENTER INTO A~ ACCESS EASEMENT AGREEMENT
(the "Agreement") is made as of the ~ day of ~c.J'f)W ; 2007, by and between Carlos G.
Oroza and Maria Oroza, as husband and wife (collectively "Oroza") and Jean Murph, an
individual ("Murph").
R E C I TAL S:
This Agreement is entered into upon the basis of the following facts, understandings and
intentions of the parties hereto:
1. Oroza is the owner of the parcel ofland situated in Coppell, Dallas County, Texas, being
more particularly described on Exhibit "A" attached hereto, and which is identified as the "Oroza
Tract" on the site plan (the "Site Plan") attached hereto as Exhibit "B".
2. Murph is the owner of the parcel of land situated immediately adjacent to the Oroza
Tract, being more particularly described on Exhibit "c" attached hereto, and which is identified
as the "Murph Tract" on the Site Plan.
3. Oroza & Murph desire to obtain from each other reciprocal access easements for
vehicular, pedestrian ingress and egress and parking for the benefit of the both the Oroza Tract
and the Murph Tract.
NOW, THEREFORE, in consideration of the sum of Ten Dollars ($10.00) and
other good and valuable consideration paid by Oroza to Murph the receipt and sufficiency of
which is hereby acknowledged, Oroza and Murph agree and covenant as follows:
1. Ae:reement to enter into Covenants and Mutual Access Easements. Oroza and
Murph do hereby declare, the intent to create and establish non-exclusive perpetual ten (10) foot
easements for vehicular and pedestrian ingress and egress over, upon and across those portions
of the Oroza Tract and the Murph Tract as depicted and described on Exhibit "D" attached hereto
for all purposes for the use and benefit of Oroza and Murph, their heirs, legal representatives,
successors and assigns, and their respective employees, tenants, and licensees. Oroza and Murph
further agree to memorialize the intent of this Agreement by exchanging access easement
agreements and filing such agreements in the proper county of record.
2. Survey. Lee:al Description and Permits. Oroza shall obtain and make available a
survey and legal description necessary to properly identifY the easements to be granted. Further,
Oroza shall obtain all necessary pennits for the construction of the driveway and parking lots as
depicted and described on Exhibit "D" attached hereto.

3. Construction and Maintenance of Drivewav. Parkine: Lots. and Fence. Oroza shall
cause and shall bear the sole expense of the construction of the driveway, parking lots and new
fence upon the Murph Tract as depicted and described on Exhibit "D" attached hereto. Further,
Oroza shall bear the sole expense of maintaining the constructed driveway, parking lots and
fence located on the Murph Tract until such time as Murph decides to construct a new building
on the Murph Tract or sells, transfers, or conveys her current interest in the Murph Tract.
Notwithstanding the foregoing, each owner shall continue to provide insurance covering their
individual tract and shall also continue to bear at their individual expense, ad valorem taxes, any
other assessments, and other such requirements or incidents of ownership.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement to be
effective as ofthe date set forth below.
