ANORDINANCE OF THECITY OFCOPPELL, TEXAS ORDINANCE NO. 91500-A-730 ANORDINANCE OFTHECITYOFCOPPELL, TEXAS, AMENDING THECOMPREHENSIVE ZONING ORDINANCEAND MAPOFTHECITY OFCOPPELL, TEXAS, ASHERETOFORE AMENDED, BYGRANTING A CHANGE INZONINGC (COMMERCIAL) ANDPD-217R2-C (PLANNED DEVELOPMENT-217REVISION 2-COMMERCIAL) TOPD-217R3-C, PLANNED DEVELOPMENT-217REVISION 3-COMMERCIAL), TO AMEND ANDEXPANDANDAMEND THEDETAILSITEPLAN TO CONVERTTHEEXISTING BUILDING ONLOT 4RINTOAKENNEL RESCUE) ANDSELF-SERVEPET WASH; TO ALLOWTHE CONSTRUCTION OFANAPPROXIMATE 4,590SQUAREFOOT BUILDING FORAFACILITY ANDALLOW SUCHFACILITYTOUSE ASADAYCARE, BOARDING ANDGROOMINGON LOT5; ANDTO ESTABLISH A CONCEPT PLANFORFUTURE DEVELOPMENT ONLOT6, BEINGMORE PARTICULARLYDESCRIBED INEXHIBIT “A” ATTACHEDHERETO ANDINCORPORATED HEREIN; PROVIDINGFORTHEAPPROVAL OF THE SITEPLAN, LANDSCAPE PLAN & TREESURVEY, ANDTHE ELEVATIONS & RENDERINGANDFLOORPLANFORLOT 5, ATTACHED HERETO ASEXHIBITS “B”, “C”, “D” AND “E” RESPECTIVELY; PROVIDING DEVELOPMENT REGULATIONS; PROVIDING AREPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING ASAVINGSCLAUSE; PROVIDING APENALTY OF FINENOTTOEXCEED THESUMOFTWOTHOUSAND DOLLARS 2,000.00) FOR EACHOFFENSE; ANDPROVIDING ANEFFECTIVE DATE. WHEREAS, theCityPlanning andZoningCommission andthegoverning bodyoftheCity of Coppell, Texas, incompliancewith thelaws oftheStateofTexas andpursuant tothe Comprehensive ZoningOrdinance oftheCityofCoppell, have givenrequisite notices bypublication andotherwise, andafter holdingduehearings andaffordingafullandfairhearing toallproperty ownersgenerally, andto allpersonsinterested andsituatedin theaffected areaandinthevicinity thereof, thesaidgoverningbodyisof theopinionthatZoning ApplicationNo. PD-217R2-C should beapproved, andintheexercise oflegislativediscretion have concluded thattheComprehensive Zoning OrdinanceandMap should beamended. NOW, THEREFORE, BE ITORDAINEDBYTHECITYCOUNCILOFTHECITY OF COPPELL, TEXAS: SECTION1. ThattheComprehensive Zoning OrdinanceandMapof theCityofCoppell, Texas, dulypassedbythegoverningbody oftheCityofCoppell, Texas, asheretofore amended, be andthesame isherebyamendedtogrant achange inzoningfromC (Commercial) andPD-217R2-C TM103085 1 PlannedDevelopment-217Revision 2-Commercial) toPD-217R3-C, (PlannedDevelopment-217 Revision 3-Commercial), toamendandexpandtheDetail SitePlanfor0.654 acres in theNorthlake Woodlands Addition, Lots4R-6 ofBlockA andtoallow theconstruction andmaintenance of an approximate4,590 squarefootbuildingforLot5; to allowforauseaskennel (rescue), petwashon 0.477 acresidentifiedasLot4R; and, toestablisha ConceptPlan forfuture developmentonthe remaining0.346 acres identifiedas Lot6; and, beingmore particularly described inExhibit “A” attachedhereto andmade aparthereofforallpurposes, subject tothe development regulations. SECTION2. That PD-217R3-C isherebyapproved subjecttothe followingdevelopment regulations: A. Exceptasamended hereinandas providedinthisOrdinance, theproperty shallbe developedinaccordance with Commercial zoned property assetforthinOrdinance 91500-A-518whichisincorporatedherein assetforthinfullandhereby republished. B. Thehoursofoperationfor theusesprovided shallnot exceedthehoursof operation of thepetdaycare; and, allsuchuseshall bebetweenthe hoursof6:00amand 11:00pm. C. Thereshallbeshared parkingforLots4Rand5. D. Thedumpstershallserve andbesharedbytheoccupants ofLots4R, 5and6ofBlockA. E. ADetailedSitePlanshallberequiredat thetime ofredevelopment ofLot6 F. Nobuilding permitshall beissueduntiltheproperty isreplattedin accordancewiththe CodeofOrdinance. G. Allsignage shallbeapprovedadministratively andshallbeuniform andincompliance withtheCodeofOrdinances. SECTION3. ThattheSitePlan, LandscapePlan & TreeSurvey, ElevationsandBuilding Prescriptive andRendering, including signageandFloorPlan andall commentsandnotes toeach suchexhibitsforLot5, attachedheretoas Exhibits “B”, “C”, “D” and “E” aremade aparthereof for all purposes, andhereby approvedasdevelopment regulations. TM103085 2 SECTION4. That theaboveproperty shallbeused onlyinthe manner andfor thepurpose providedforbythe ComprehensiveZoningOrdinance oftheCityofCoppell, asheretofore amended, andasamendedherein. SECTION5. Thatthedevelopment oftheproperty herein shallbe inaccordance with building regulations, zoning ordinances, and anyapplicableordinancesexcept asmay bespecifically altered oramended herein. SECTION6. Thatallprovisions oftheOrdinances oftheCityofCoppell, Texas, inconflict withtheprovisionsofthisordinancebe, andthesame arehereby, repealed, andallother provisions not inconflict withtheprovisions ofthisordinanceshall remain in fullforce andeffect. SECTION7. That shouldanysentence, paragraph, subdivision, clause, phrase orsectionof thisordinance beadjudgedorheld tobeunconstitutional, illegalorinvalid, thesame shallnotaffect the validityofthisordinanceas awhole, or anypartorprovision thereof other than thepartsodecided to beunconstitutional, illegal orinvalid, andshallnotaffectthevalidityoftheComprehensive Zoning Ordinance asa whole. SECTION8. Anoffensecommittedbeforetheeffectivedateofthisordinance isgoverned byprior lawandtheprovisions oftheComprehensive ZoningOrdinance, asamended, ineffectwhen the offensewascommitted andthe formerlaw iscontinuedineffect forthis purpose. SECTION9. Thatanyperson, firmorcorporation violatinganyofthe provisionsorterms ofthisordinance shallbe subjectto thesamepenaltyas providedfor intheComprehensive Zoning OrdinanceoftheCityofCoppell, asheretofore amended, anduponconvictionshallbepunished by afinenottoexceedthesumofTwoThousand Dollars ($2,000.00) foreachoffense; andeachand everydaysuchviolation shallcontinueshallbedeemed toconstituteaseparateoffense. SECTION 10. Thatthisordinance shalltakeeffect immediately fromandafteritspassage andthepublication ofitscaption, asthe lawandcharter insuchcases provide. TM103085 3
