WHEREAS, theCityPlanningandZoningCommissionandthegoverningbodyoftheCity ofCoppell, Texas, incompliancewiththelawsoftheStateofTexasandpursuanttothe ComprehensiveZoningOrdinanceoftheCityofCoppell, havegivenrequisitenoticesbypublication andotherwise, andafterholdingduehearingsandaffordingafullandfairhearingtoallproperty ownersgenerally, andtoallpersonsinterestedandsituatedintheaffectedareaandinthevicinity thereof, thesaidgoverningbodyisoftheopinionthatZoningApplicationNo. S-1263-Cshouldbe approved, andintheexerciseoflegislativediscretionhaveconcludedthattheComprehensiveZoning OrdinanceandMapshouldbeamended. NOW, THEREFORE, BEITORDAINEDBYTHECITYCOUNCILOFTHECITY OFCOPPELL, TEXAS: SECTION1. ThattheComprehensive ZoningOrdinanceandMapoftheCityofCoppell, Texas, dulypassedbythegoverningbodyoftheCityofCoppell, Texas, asheretoforeamended, be andthesameisherebyamendedtograntachangeinzoning from C (Commercial) toS-1263-C SpecialUsePermit-1263-Commercial) toallowacombinedgrocerystore, restaurantretailsales andofficein3,466squarefootleasespacetobelocatedinSuite505of751S. MacArthurBlvd, 1 TM95417 on1.07acresofland, andbeingmoreparticularlydescribedinExhibit “A” attachedheretoandmade aparthereofforallpurposes, subjecttothedevelopmentregulations. SECTION2. ThatS-1263-Cisherebyapprovedsubjecttothefollowingspecialconditions: A. Theusespermittedwithinthisleasespaceshallincludeacombinedrestaurant, grocery store, retailandoffice. B. Thehoursofoperationshallbefrom11a.m. to10p.m., sevendaysaweek. C. Theinstallationofafiresprinklersystemwillberequiredifthesquarefootageofthe restaurantexceeds2,100squarefeet. D. AttachedsignageshallcomplywithChapter12, Article29, oftheCoppellCodeof Ordinances, asamended. SECTION3. ThattheSitePlan, FloorPlanandElevationandSignPlan, shallbespecial conditionsandareattachedheretoasExhibits “B”, “C”, “D” and “E”, respectively, aremadeapart hereofforallpurposes, andherebyapproved. SECTION4. Thattheabovepropertyshallbeusedonlyinthemannerandforthepurpose providedforbytheComprehensiveZoningOrdinanceoftheCityofCoppell, asheretoforeamended, andasamendedherein. SECTION5. Thatthedevelopment ofthepropertyhereinshallbeinaccordancewith buildingregulations, zoningordinances, andanyapplicableordinancesexceptasmaybespecifically alteredoramendedherein. SECTION6. ThatallprovisionsoftheOrdinancesoftheCityofCoppell, Texas, inconflict withtheprovisionsofthisordinancebe, andthesamearehereby, repealed, andallotherprovisions notinconflictwiththeprovisionsofthisordinanceshallremaininfullforceandeffect. SECTION7. Thatshouldanysentence, paragraph, subdivision, clause, phraseorsectionof thisordinancebeadjudgedorheldtobeunconstitutional, illegalorinvalid, thesameshallnotaffect 2 TM95417
