ELECTRIC & UTILITY EASEMENT

KNOW ALL MEN BY THESE PRESENTS
COUNTY OF DALLAS §
THAT the term Grantor used herein shall be construed in the singular or plural
number as such term respectively represents one or more than one person.

known herein as GRANT , in consi ration of the sum of Ten and No/100 Dollars ($10.00) and
other good and valuable consideration in hand paid by the City of Coppell,Texas, receipt of which
is hereby acknowledged, does by these presents grant, bargain, sell and convey unto the City of
Coppell,Texas, ("GRANTEE"),the non-exclusive, free and uninterrupted use, liberty and privilege
of passage in, along, upon and across the following described property owned by GRANTOR (the
Electric & Utility Easement") for the purpose of constructing utility improvements on
GRANTOR'S main tract with the right and privilege at all times, of the GRANTEE herein, its
agents, employees, workmen and representatives having ingress, egress, and regress in, along, upon
and across said Electric & Utility Easement for the purpose of making additions to, improvements
on and repairs to said utility improvements or any part thereof.
Said Electric & Utility Easement being described in Exhibits "A" and "B" attached hereto
and made a part hereof for all purposes.
That in consideration of the benefits above set out, GRANTEE will remove from the
Electric & Utility Easement, such fences, buildings and other obstructions as may be found upon
said property as is reasonably necessary to install the utility improvements. After construction of
the utility improvements has been completed, GRANTEE shall, except for removed obstructions,
return the surface area of the Electric & Utility Easement to its original condition as nearly as
practical taking into consideration the nature of the work being performed. GRANTOR reserves the
right to use and maintain the surface of the Electric & Utility Easement for purposes which will not
interfere with GRANTEE'S rights hereby granted (including, but not limited to, landscaping,
parking surfaces, curbs cuts, drive lanes and other utilities) and agrees that upon completion of the
utility improvements and restoration of the surface, GRANTEE shall not be obligated for future
maintenance and upkeep of the surface area. Notwithstanding the foregoing, GRANTEE shall be
responsible for repairing any damage to the surface area of the Electric &Utility Easement, and any
other property or improvements owned by GRANTOR, to the extent caused by GRANTEE, its
agents, contractors or representatives, in connection with any future repairs, maintenance, alteration
or replacements to the utility improvements.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns for
the purposes aforesaid,the premises above described.

15' WIDE ELECTRIC & UTILITY EASEMENT"
Being 1,088 square feet of land situated in Lot 3, Block A, Arbor Manors, an addition to
the City of Coppell, Dallas County, Texas, as filed in Instrument #20080292484, Plat
Records of Dallas County, Texas (P.R.D.C.T), and being described in deed to Ardinger
Properties, L.L.C., according to the deed filed in Instrument #201000272924, Deed
Records of Dallas County, Texas (D.R.D.C.T.); said 1,088 square feet of land being more
particularly described by metes and bounds as follows:
BEGINNING at the southeast corner of said Lot 3, also being the northeast corner of a
tract of land described in deed to CBC Property Holdings, LP, a Texas limited partnership,
according to the deed filed in Instrument #201100253042, D.R.D.C.T., and also being in
the west Right-of-Way(R-O-W) line of Denton Tap Road(variable width);
THENCE S 87°20'00" W, along the south line of said Lot 3 and along the north line of
said CBC Property Holdings tract, a distance of 15.00 feet, from which a 1/2 inch iron rod
found at an angle point in said line, bears S 87°20'00"W, 45.00 feet;
THENCE N 02°39'47" W, over and across said Lot 3, a distance of 72.54 feet to the south
line of a 25' Ingress, Egress, Parkway, Utility & Drainage Easement, as filed in Volume
87229, Page 2137, P.R.D.C.T.;
THENCE N 87°17'06" E, continuing over and across said Lot 3, along the south line of
said 25' Ingress, Egress, Parkway, Utility & Drainage Easement, a distance of 15.00 to the
east line of said Lot 3, also being in said west R-O-W line of Denton Tap Road, from which
an "X" found cut in concrete at the northeast corner of said Lot 3, also being the southeast
corner of Lot 1, Block A, M.P. McDonald's Addition, an addition to the City of Coppell,
Dallas County, Texas, as filed in Volume 87233, Page 2925, P.R.D.C.T., bears
