Box 478 Coppell, Texas 75019 Re: Replat - Valley Ranch Plaza, Pads B-F and Case No. S-1070 Boston Chicken Restaurant Dear Taryon: I have reviewed the letter you faxed to me concerning the above mentioned matter which was sent by attorney W.T. Leake representing Curtis L. Graf and Ronald J. Krause, the fee owners of Pad H of Valley Ranch Plaza. You asked whether or not we need to respond or take any action. Mr. Leake says that his clients are the owners of a non-exclusive perpetual easement for ingress and egress to Pad H over and across Pad F and G of Valley Ranch Plaza as per the recorded plat. Mr. Leake says that Case S-1070, which is evidently a zoning application of Boston Chicken Restaurant will cut off his clients' easement. This matter does need to be looked into. We need to determine all of the facts up to date prior to the City taking any affirmative action that might interfere with the easement mentioned. A review of this matter would certainly require review of the replatting process mentioned in Mr. Leake's letter.
