City Council Memo1 MEMORANDUM To: Mayor and City Council From: Mindi Hurley, Director of Community Development Date: November 9, 2021 Reference: PUBLIC HEARING: Consider approval of case PD-231R-H, a zoning change request from PD-231-H (Planned Development-231-Historic) to PD-231R-H (Planned Development-231 Revised-Historic), to change from a Planned Development, which was never constructed, and allow the tracts to continue their use as residential within the existing residential structures, located on three tracts of land totaling approximately 0.434 acres, located at 528 and 532 S. Coppell Road, at the request of Jean Murph, Debbie Baum and Russell Schneider, being represented by Debra Edmondson, Edmondson Law Firm 2040 Pillars: Enhance the Unique “Community Oasis” Experience Executive Summary: The owners of 528 S. Coppell Rd & 532 S. Coppell Road wish to change the current zoning for the properties from PD-231-H, which calls for a proposed two-story office building, a residence, and shared parking, to the existing conditions- two single family residences. Introduction: The northern property was previously owned by Carlos and Maria Oroza between 2006-2009 who were proposing to construct the office and shared parking with the residence on the rear of the southern lot. However, after the zoning was approved, the Orozas were never able to move forward with their approved plans and never filed the plat. Subsequently, the property was sold to Charles Price. Then, in May 2019, Ms. Baum purchased the property from him. She recently was unable to refinance the property, because of the current zoning on the property calling for office. Jean Murph owns the southern property. Analysis: Staff recommends allowing the rezoning of the property to revert back to the existing conditions. This will allow the existing development to exist as is and if burned or destroyed, to be rebuilt. However, this would not be allowed to be expanded. A redevelopment of the property beyond the boundary of the existing footprints would require a new PD zoning. Each lot will have a separate PD Ordinance, which will alleviate the need for both property owners to join in a future zoning application. Legal Review: Staff consulted with the City Attorney and separate ordinances for each of the properties will be acceptable, if approved. 2 Fiscal Impact: None Recommendation: On October 21, 2021, the Planning and Zoning Commission unanimously recommended approval of the request subject to the correct deed information being shown on the plans which has since been rectified.
