HEARING DATE: December 10, 1991 LOCATION: 420 Bethel Road SIZE OF AREA: Approximately 11,000 square feet lB0' X 134') REQUEST: Zoning change request from (R) Retail to (R-SUP) Retail Special Use Permit, for the operation of an office and floral shop. APPLICANT: Mrs. Joy Onstatt 14410 Southern Pines Drive Dallas, Texas 75234 (214) 247-2750 HISTORY: The existing parcel includes a single-family structure built many years ago, was constructed as a single-family residence. Mrs. Joy Onstatt, applicant, recently purchased the structure and the land upon which it sits. TRANSPORTATION: Bethel Road is presently a two-lane substandard thoroughfare along this area, and future plans indicate a two-lane undivided in the future. SURROUNDING LAND USE & ZONING: North - Retail Zoning South - Retail Zoning East - Retail Zoning West - Retail Zoning ITEM 6 COMPREHENSIVE PLAN: Coppell's masterplan suggests single-family development, north of Bethel Road, and east of Coppell Road. But this recommendation was made in 1985, which was prior to the formation of the Coppell Historical Committee for the old-town area. Recent discussions with the Historical Committee indicate a desire for mixed-uses for this area of Coppell. ANALYSIS: Located on the subject property, is a residential structure which was is existence prior to the time the property was zoned for (R) Retail uses. The applicant purchased the property in order to convert the structure to a floral shop and office. As a requirement of the Comprehensive Zoning Ordinance, where a non-conforming structure is to be used only for a specific business and not a residential use, the applicant must obtain a special use permit for the specific use being conducted in such a structure. Said business use may not be changed nor the structure converted to a combined residence, without a special use permit. If approved, this special use permit will allow the operation of a floral shop and office within a non-conforming residential structure. Some opposition to this request has been expressed by the Coppell Historical Committee. The primary concern of this committee is that uses such as a beauty shop, would be allowed as a part of this request for a RSUP zoning designation. Retail zoning allows office uses as well as retail. Staff suggests that the Special Use Permit be limited to a floral shop and/or administrative or professional offices. This type of action will help to alleviate any undesirable uses within the proposed Historical District. It is staff's understanding that the Historical Committee will be present at the planning hearing and will discuss the areas that they are concerned with. In summary, staff has no objections to this request to allow the operation of a floral shop/professional or administrative offices at this site; however, we recommend that the permit be limited to these types of uses. Councilman Morton seconded the motion; motion carried 7-0 with Mayor Pro Tem Smothermon and Councilmen Weaver, Thomas, Morton, Cowman, Robertson and Nelson voting in favor of the motion. Item 14 Consideration and approval of a preliminary plat, for Chaucer Estates Addition, located at the northwest corner of Sandy Lake Road and Heartz Road, at the request of Alpine Development. Following discussion, Mayor Pro Tem Smothermon moved to approve the preliminary plat for Chaucer Estates Addition, located at the northwest corner of Sandy Lake Road and Heartz Road, with renderings attached as part of application. Councilman Nelson seconded the motion; motion carried 7-0 with Mayor Pro Tem Smothermon and Councilmen Weaver, Thomas, Morton, Cowman, Robertson, and Nelson voting in favor of the motion. Item 15 PUBLIC HEARING: Consideration and approval of a zoning change, Case #S-1055, from (R) Retail, to (R-SUP) Retail Special Use Permit, to allow the operation of an office and floral shop, located at 420 Bethel Road, at the request of Mrs. Joy Onstott. Mayor Wolfe declared the Public Hearing open. He asked for those persons who wished to speak against the proposed zoning change. There were none. He then asked for those persons who wished to speak in favor of the proposed zoning change. Again, there were none. Mayor Wolfe then declared the public hearing closed. Lindy Thomas of 514 Parkview Place representing the Coppell Historical Committee addressed the Council pertaining to this item. Following discussion, Councilman Nelson moved to approve the zoning change Case ~S-1055 from (R) Retail to (R-SUP) Retail Special Use Permit to allow the operation of an office and floral shop, located at 420 Bethel Road, at the request of Mrs. Joy Onstott. Councilman Thomas seconded the motion; motion carried 7-0 with Mayor Pro Tem Smothermon, Councilmen Weaver, Thomas, Morton, Cowman, Robertson and Nelson voting in favor of the motion. Item 16 PUBLIC HEARING: Consideration and approval of a zoning change, Case #S-1056, from (C) Commercial, to (C-SUP) Commercial Special Use Permit, to allow the operation of a restaurant, located at 150 S. Denton Tap Road, at the request of Mr. Michael Herschmann. Gary Sieb, Director of Planning and Community Service, made the presentation to the Council. Lawrence Steinburg, representing the applicant, Michael Herschmann, also made a presentation to the Council in reference to Jacky Chart Chinese Restaurant. Mayor Wolfe declared the Public Hearing open and asked for those persons who wished to speak against the proposed zoning change. There were none. He then asked for those persons who wished to speak in favor of the proposed zoning change. Again, there were none. Mayor Wolfe then declared the Public Hearing closed. Following discussion, Mayor Pro Tem Smothermon moved to approve zoning change Case #S-1056 from (C) Commercial to (C-SUP) Commercial Special Use Permit to allow the operation of a restaurant, located at 150 S. Denton Tap Road. Councilman Cowman seconded the motion; motion carried 7-0, with Mayor Pro Tem Smothermon and Councilmen Weaver, Thomas, Morton, Cowman, Robertson, and Nelson voting in favor of the motion.
