TRANSPORTATION:
Sandy Lake Road is projected to be a four-lane divided
thoroughfare in a six-lane r.o.w (C4D/6). The County is
currently doing its engineering design from MacArthur to 35E.

COMPREHENSIVE PLAN: The Plan shows commercial uses as most appropriate here.
ANALYSIS:
This is an expansion of an existing restaurant--Gloria's Pizza--and as such does
not necessitate a great deal of staff comment. The restaurant is requesting to
expand into a 700 square foot space immediately west of the existing restaurant
recently vacated by an insurance office, and utilize the space for banquet
facilities. The only potential problem staff could foresee was the fact that parking
in this strip center appears tight. The applicant has assured us that she has
always had adequate parking, that the majority of her business occurs when the
other businesses are not at peak capacity. Of the 25 total parking spaces, 23
would normally be allotted to the restaurant. To compensate, we have been
advised that staff for all the center businesses park north of the building, thus
freeing up the 25 space parking lot for customers. In addition, the pizza
restaurant has been in operation here a long time and non-conforming rights could
also be argued. At any rate, we are satisfied that a parking problem does not
seem to exist with the current tenant mix.
Because the existing restaurant never procured an SUP--it predated the 1990
zoning requirement--we would recommend that the SUP be granted for Gloria's
Pizza en toro, that the amending ordinance specify that if a new operator
purchases the restaurant the Planning Commission or City Council may initiate
a zoning change. That appears unlikely here, but the Zoning Ordinance (Sec.
30, 2) requires such potential action be noted on the amending ordinance.
Staff recommends approval of this zoning request.

Councilmember Watson filed a Conflict of Interest with the City Secretary and withdrew from
discussion and voting on this item in accordance to the Code of Conduct. Mayor Pro Tern
Robertson moved to approve Consent Agenda Item 10 L, and authorizing the Mayor to sign.
Councilmember Reitman seconded the motion; the motion carried 5-0 with Mayor Pro Tem
Robertson and Councilmembers Alexander, Reitman, Mayo, and Sheehan voting in favor of the
motion.

Mayor Morton opened the Public Hearing and asked for those persons wishing to speak against
this proposal. There were none. He then asked for those persons wishing to speak in favor of
the proposal. Again, there were none. Councilmember Reitman moved to close the Public
Heating and approve S-1085, Gloria's Pizza, zoning change from C (Commercial) to C-S.U.P.
(Commercial, Special Use Permit), to allow expansion of the existing restaurant located at the
north side of Sandy Lake Road between Kimbel Court and MacArthur Boulevard at the request
of Gloria Salerno. Mayor Pro Tem Robertson seconded the motion; the motion carried 6-0 with
Mayor Pro Tem Robertson and Councilmembers Alexander, Watson, Reitman, Mayo and
Sheehan voting in favor of the motion.
