WI~.~S, the City Planning and Zoning Commission and the governing body of the City of Coppell, Texas, in compliance with the laws of the State of Texas and pursuant to the Comprehemive Zoning Ordinance of the City of Coppell, have given requisite notices by publication and oflmrwi~ and after holding due heatings and affording a full and fair hearing to all property owners generally, and to all persons intereated and situated in the affected area and in the vicinity thereof~ the said governing body is of tho opinion that Zoning Application No. S-] 1 ]6 should be approved, and in tho exercise of legislative discretion have concluded that the Comprehensive Zoning Ordinance and Map should bo amended. NOW, Ti~2REFORE, BE IT ORDAINED BY ~ CITY COUNCIL OF Tm. CITY OF COPPEI.I ~ TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended to grant a change in zoning ~om "PD-C" (Planned Development, Commercial) to "PD-C-S.U.P." (Planned Development-Commercial, Special Use Permit) to allow a private dub for a restaurant use with special conditions for property described in Exhibit "A" aaached hereto and made a part hereof for aH purposes. SS3537 SECTION 2. That the above change in zoning for Special Use Permit to allow for private club use is hereby granted, subject to the following special conditions. 1. Maximum total indoor sealing capacity "of 156 and maximum total outdoor patio seating capacity of 60. 2. Compliance with all the conditions specitied in Section 30=16 of the Zoning Ordinance relative to Special Use Permits for restaurants. 3. The properly shah be developed and used only in accordance with the Site Plan, Floor Platt/Equipment Schedule, and Sign Criteria attached hereto as Exhibit "B", "C", and "D" respectively, and made a part hereof for aH purposes. S~ON 3. That the Site Plan, Floor Plan/Equipment Schedule, and Sign Criteria attached hereto as Exlu~its "B", "C", and "D", respectively, and made a part hereof for aH purposes, is hereby, approved. That the above property shaH be used only in the manner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and as amended hereh~ SECTION 5. That aH provisions of the Comprehensive Zoning Ordinance of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and aH other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 6. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to 2 S$3537 be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 7. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Comprehensive Zoning Ordinance, as mended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 8. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such violation shall continue shall be deemed to constitute a separate offense. SECTION 9. That this ordinance shall take effect mediately from and after its passage and the publication of its caption, as the law and charter in such cases provide. MacARTFFUR BLVD. COPPELL, TEXAS 75019 GI~.NERAL - Thc sign Criteria as se~ forth herein shall govern all outdoor signage to be used or displayed by the Tenants of"Vatley Ranch Plaza". This will insure quality signase throughout the center while maintaining architectural standards pleasing to ali Tenants. Consideration will be given to allow maximum flexibility of sign designs, individuality and creativity within the limits described below: 1. COPY PERMITFS'-D Sign copy shall be limited to the name under whidt Tcflant is doing business. When Tenant has a 1o8o or trademark used in conjunction with his name, he may seek Landlord's approval for its use on his signa~e. Such Iosos will be required to meet location, color and other specifications defined herein unless approved in writing by Landlord. Logos will be permitted only as an inte$ral part of the lettering of the sign. No product logos are permitted. 2. SIGN CRITERIA I SPE.CJ'FICATIONS All Tenant signs must be designed, fabricated and installed to comply with the following criteria and specRications: A. Sign Types: All signs must be individual internally illuminated neon channel letters with plastic translucent fitces. Painted faces a.re not acceptable. B. Letter Styles: No particular styt. e has been specified, however, the Tenant must secure the Landlord's prior written approval. C. Number of' Signs: Each Tenant will be allowed one sig~ per storefi'ont not to exceed 70% of'storefront width. D. Area: The si~n areas arc limited to one (1) square foot of sign area of each lineal foot of' lease space frontage. E. Letter Size: The maximum height of any letter or logo shall be 30". A maximum of two lines of'copy shall be permitted. All signaffe shall comply with the attached elevations with r .effard to size and placement. Ail letters shall be a uniform 5" in depth. Signase shall be located so as to align the center line of' the signage with the center line of the Teaam's storefrom width, or centered on building tower. F. Letter channels (Returns): All letter returns shall be formed from aluminum in minimum thickness of .063 inches. Depth of channels shall be 5 inches. B. Letter Backs: Letter backs and retainer rinss are to be made of aluminum in minimum thickness of.090 inches. Armorply, plymetaL foam, styrene, or any other inflammable material shall not be used under any circumstances. C. Letter laces: AU letter faces are to be Rolun ~ Haas pigmented plexiglass, thickness of. ! 875 inches. D. Drain holes shall be placed at the bottom of each letter. 4. ELK~CAL REOUIREMKN~'S A. White ~ letters shall be illuminated with 13mm 60MA neon - ~f~500 white. Letters with stroke width 8reate' than 4 inches shall have two tubes of neon. Transformers shall be all copper wound ~'Franc¢:' or "Jefferson" tta~:sformers, wi~h no mote than 50 feet of neon loaded pet transformer. All transformers to be installed in transformer boxes for fire protection. Transformer boxes to be located behind signband fascia. B. No secondary wiring running between individual letters shall be permitted. Amp load shall be computed and shown on drawings. 5. f~STALLATION A. Individual letter shall be pin-mounted or keyhole bracket mounted such that the letter is held a&ains~ the spandret brick. AI~ letters shall be mounted to meet U.L. Standards. B. All mounting and electrical connections shall be made throt~,h mortar joints only. C. No exposed raceways or transformers are permitted. 6. STORE_FRO.~T AND SERVICE DOOR SIGNAGE A. Store~ront Si,~cnage: Permanently painted or attached door si~s are not permitted. Refer to attached drawing for storefi'ont signage criteria. 13 Service Door Signs: Sis;nage at these doors will be limited to the Tenant's name and suite number, in white Helvetica style, a maximum of'~" hish, centered on door face, 5' - 6" above bottom of door.
