Decision of P&Z Commission: Approval (5-0) with Commissioners Jones,
Wheeler, Cruse, DeFilippo and McCaffrey voting in favor. Commissioners
Mabry and Lowry were absent.
Approval subject to the Site Plan and the'following conditions:
1) External surface of 8'-high screen wall to be faced with Patriot
Executive brick from the U.S. Brick Mineral Wells plant, or any
equivalent in color and size.
2) Maintenance of foundation planting as shown, with planting of a
species capable of survival without an irrigation system.
3) Compliance with Fire Department requirements or a written waiver
of requirements by the Fire Department. Requirements are as
follows:
(a) Show access and fire lane.
(b) Show location of closest fire hydrant.

HISTORY: In 1994 the City reclassified the zoning of this property from MF-
2, Multi-Family Residential to R, Retail. A lawsuit resulted. As
part of a settlement agreement not yet approved by the court, the
City changed the zoning to "C" Commercial in late 1995. In
connection with rezoning and platting of land north of Riverchase
Drive, the owners of the property have submitted conceptual plans
for the development of the total property, both north and south of
Riverchase Drive, but to date there has been no other zoning
reconsideration or platting activity on the southern portion.
TRANSPORTATION: MacArthur Boulevard is a 4 lane divided thoroughfare built in a
110'-wide right-of-way shown on the thoroughfare plan as a P6D,
6-lane divided thoroughfare.

COMPREHENSIVE PLAN: The Comprehensive Plan shows this property suitable for
regional retail uses.
DISCUSSION: Located in the least accessible portion of an undeveloped commercial
property, next to a rail fight-of-way and an electric transmission line, the
use is suitable, subject to the provision of adequate screening.
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
The planning staff recommends approval subject to:
1) Screening on all four sides by an 8'-high wall faced on the external
surface of each side with Patriot Executive bfiek from the U.S.
Bfiek Mineral Wells plant, or the equivalent.
2) Foundation planting on the external side of the screenwall using
species capable of survival without an irrigation system.
3) Compliance with Fire Department requirements.
ALTERNATIVES: 1) Recommend approval of the Special Use Permit.
2) Recommend disapproval of the Special Use Permit
3) Recommend modification of the Special Use Permit
4) Take under advisement for reconsideration at a later date.

Dear Mr. Rudd:
I have,received your letter dated November 8, 1996 in which you request that the fire
lane requirement for you project be waived. After careful review, it has been determined
that the requirement for .a six inch thick concrete fire lane can be modified in order to
meet your specific location. In lieu of the concrete fire lane, the Coppell Fire
Deparm~ent can allow ~n all wea~er surface capable of supporting 40,000 pounds. This
surface is to ran from the closest access point on South MacArthur to the project site.
This all weather s~fface may be asphalt or crushed rock or other material capable of
meeting the load bearing requirements.

SCREENING WALL
An 8' high wall, faced on the external surface with brick will be constructed 2' inside the
proposed lot lines. The brick will match the Patriot Executive brick from the U. S. Brick's
Mineral Wells Plant in color and size.
FOUNDATION PLANTING
Forty eight Fraser's Phontinia's (Photinia Fraseri) will be planted approximately 2 fi. apart along
the outside of the 8' high brick screening wall.
