The final plat for the retail building was approved by City Council on May 12, 1998. TRANSPORTATION: Denton Tap Road is an improved six-lane divided thoroughfare (P6D) contained within a 100'-wide right-of-way. Town Center is an access street with a variable right-of-way width. SURROUNDING LAND USE & ZONING: North- Vacant; TC South - Comerica Bank; TC East - City of Coppell, Police & Courts Facility Addition; TC West - Sonic Restaurant; C-S.U.P. COMPREHENSIVE PLAN: The Comprehensive Plan shows the property as suitable for mixed uses. Item # 5 DISCUSSION: The applicant is proposing a Subway sandwich shop that will also serve TCBY frozen yogurt products. The new facility will seat a total of 66 people. Staff is comfortable with the store layout. The proposed hours of operations are as follows: 10:00 am to 11:00 pm Monday through Thursday; 10:00 am to 12:00 am Friday and Saturday; and 10:00 am to 11:00 pm. Sunday The subrm'tted sign elevations indicate a white and yellow channel letter sign with brown trimcaps measuring in excess of 30 square feet over the from facade of the restaurant facing Demon Tap Road. Based on the width of the store from, applicant is allowed by city code a maximum of a 29 square foot sign. When City Council approved the site plan for this retail building it placed seven conditions. The 6th condition dealt with' sign color and limited all signs to a single color, as well as restricting signs to only channel letters in shades of light grey, light brown, beige, cream or white. Therefore, applicant will have to modify the color of the Subway sign to conform to the uniform sign color selected by the landowner, as well as reduce its size slightly. The interior TCBY neon sign is acceptable. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: The planning staff recommends approval of the special use permit subject to the following conditions being met: 1) Limit the Subway channel sign to 29 sf and the color of sign will be restricted to the uniform sign color selected by the landowner. 2) The proposed hours of operations are: Monday through Thursday: 10:00 am to 11:00 pm Friday and Saturday: 10:00 am to 12:00 am Sunday 10:00 am to 11:00 pm 3) Revise Tower Elevation to reflect the sign's proper size. BOX 769 COPPELL, TX 75019 (214) 393-5866 (21,4) 393-4822 City of Coppell September 17, 1998 City Council Members Dear Council Members, In the P&Z meeting dated September 17', 1998, I responded to an issue that dealt with limiting the Subway channel sign as it pertains to the size (total square footage) not exceeding 29 square feet and the color of its letters. Please note that this letter is included in your packag~ To both issues I agreed to the "City Code" and the City Councils agreement with the Landlord to abide by the size and color selections. I realize the city would like to have a scale drawing of the elevation and the proposed lettering as it would appear on the from of the store, but I am unable to meet the deadline for the Council meeting on the 13~ of October in terms of this presentation. I would like to further explain that the Subway Franchise supplies fixed sizes for its "Channel Letter Signage" to the franchisee, but those offerings do not meet the City of Coppell's code requirements. I, therefore, am going to have the landlords sign vendor construct a custom channel letter sign to meet the city's requirements. This effort requires the landlords sign company to be certified or approved for Subway's sign specifications. This process is underway, but will not be completed in time for the Council meeting on the 13~ of October. Because of my concern for not meeting this deadline, I conferred with Ms. Isabelle Moro of the City Planning Department. She felt that since I have already agreed to correct the issues with the Development Review Committee; wrote a letter addressing the issue to the Planning and Zoning Commission (agreeing to comply on all items) and with this additional letter to the City Council, it would provide sufficient documentation to proceed to the City Council meeting of October 13th. At the Councils request, I would also be in agreement to provide the signage drawing and it's specifications for the city records as soon as they are made available to me. Limit the Subway channel sign to 29 square feet and the color of the sign will be restricted to the uniform sign color selected by the landowner. Subway's Response: It is Subway's intent to conform to the city code on signage and will comply with the 29 square feet. Subway will also conform to the color selected by the landowner. It is also Subway's request to the Planning and Zoning Commission that it maintains its consistency with their decision, when it comes to other tenants in this center requesting variances to the landowner's choice of signage colors. Item 3. Revise Tower Elevation to reflect the sign's proper size. Subway's Response: In a phone conversation on September 15, 1998, Ms. Isabelle Moro suggested this letter would be sufficient for (Items 1 & 3) and that a revise Tower Elevation would not be necessary.
